The Bad and the Ugly
We are still actively working to “educate” our
legislators and our CRNA colleagues who are
making the case that NP’s should not be allowed
to administer moderate sedation, using Propofol.
NPARI has testified against this bill (S 3035 SUB
A). Testimony from Lifespan has outlined how this
would limit the NPs’ full practice authority and
patients’ access to care. The CRNA’s are pushing
forward with this. It created long hearings in the
House and Senate. NPARI testified against. The
issue will be taken up by the Board of Nursing
and will hopefully not have to go to statute.
Lastly, still brewing, is the “Medspa” bill (H8296)
which would require that all NP’s who work in
esthetics practices would have to be directly
supervised by on-site physicians. This threatens
our practice authority, as well.
So, for now, this is your legislative summary. We

The Bad Impact
from the front lines
As ACNP’s working in Critical Care, we are
continuing to treat our patient populations
within our scope of practice, while fighting for
our ability to maintain the use of moderate
sedation for certain disease processes. We
are showing up to contest this bill and
sharing our stories in the hopes of educating
others on the impact this bill will have, if
passed, on the communities served in and
around RI. Patients will cross state lines and
seek care in surrounding states for their
acute needs that we, as ACNPs, are trained
to treat, which will have a negative impact on
the medical facilities in the state of RI.

The “Ugly” Impact
from the front lines
The Medical Spa Safety Act (bill H8296) is
intended to restrict the role of medical director
to physicians only. This would require any
medical spa or APRN overseeing their own
aesthetics practice to hire a physician to
oversee them. This bill also states that APRNs
will need on-site supervision by the medical
director to inject or operate energy based
devices beyond the mid-epidermal layers of the
skin. The language of this bill would likely put
many aesthetic practices owned by NPs out of
business and will reduce patient access to such
services.
The primary supporters of this bill are
dermatologists and dermatologist run
aesthetic practices. Although presented as a
patient safety issue, there is a lack of data
supporting that physician run aesthetic
practices have fewer adverse events than those
run by NPs..
