After I defeated the People's Motion to Stay the trial until their appeal his heard, and determined, there is now a new trial date set for SEptember 25, 2023. Co-Counsel Mark Fonte and I are gearing up for this new trial and we are ready to go.

Decision is in. Conviction and sentence vacated and new trial ordered. While we didn't get Actual Innocence we did accomplish an extremely rare reversal of a conviction, at the trial level, on Staten Island. Tim Turner is on his way home.

On December 8 a Hearing was held on my Motion to Vacate the conviction on grounds of Actual Innocence. If successful this will be the first Actual Innocence finding on Staten Island and only the 25th in the State of New York.
