Driving Under the Influence (DUI) tips and information:

Getting arrested and charged with Driving Under the Influence can bring on difficult times and have severe consequences—even if it is a first-time DUI offense. In the state of Florida, Driving Under the Influence (hereinafter DUI) is governed by Florida Statute 316.193. Under said statute, a first-time DUI carries, at a minimum, six months of probation, a $500 fine, 50 community service hours, a six-month driver license suspension, 10-day vehicle immobilization, requires you to enroll and complete the DUI Level 1 School, court costs, among other conditions. Not to mention, you could face up to six months in jail for a first-time DUI. Additionally, depending on the circuit, you could be required to complete a Victim Awareness Program, abstain from drinking alcohol, random drug and alcohol testing at your own expense, among other factors.

The minimum mandatory requirements can be enhanced under certain circumstances. For instance, if you were involved in a crash, your breathe or blood alcohol content was 0.15 or more, or if there was a minor in the vehicle with you at the time of the offense. Under these facts, you could face more jail time, as well as more probation time, the fine is increased to $1,000 (up to $2,000 for a crash), six-month ignition interlock, up to a 12-month driver license revocation, among other conditions.

As you can see, a first-time DUI can be costly, and can significantly impact your life, reputation and employment.

The state of Florida aggressively prosecutes DUI cases; therefore, you need a law firm that is going to fight for you. Although it depends on the unique facts of the incident, we almost always utilize pre-trial defense mechanisms, such as a motion to suppress evidence, to challenge the legal validity of the matter, and to aggressively and efficiently fight your case. Some issues we attack that are specific to a DUI case include lack of probable cause for initially pulling the vehicle over, lack of reasonable suspicion for lawful detention for a DUI investigation, and/or lack of probable cause for a DUI arrest, among a myriad of other constitutional issues that can be challenged. Ultimately, by putting in the work and attacking the case from all angles, we can poke holes in the case and push to obtain the best possible result for you. If the result of said motion is favorable, it could result in your charges being dismissed or amended down to a lesser offense, such as a Reckless Driving Alcohol Related, which could conceivably be sealed or expunged from your record.

HUGE VICTORY IN COURT YESTERDAY ON A HIGH PROFILE CASE IN MARION COUNTY, FL!!! THE JURY FOUND OUR CLIENT NOT GUILTY ON ALL SIX COUNTS (FIVE CHARGES BEING SERIOUS FELONIES) AFTER FOUR DAYS OF TRIAL!!!

The client was accused of Possession of a Firearm by a Convicted Felon (a second degree felony, facing a maximum of 15 years of prison); four charges of Aggravated Assault with a Deadly Weapon (four third degree felonies- up to a maximum of 20 years of prison); and Improper Exhibition of a Firearm (a first degree misdemeanor).

Our client has been in jail for two-and-a-half years and has maintained his innocence from the moment we took over his case in November of 2021. We extensively litigated this matter—prior to taking his case to trial—including conducting numerous depositions; but sometimes the decision needs to be left up to a jury!

As Mr. Schisani told a reporter after the conclusion of this trial, the verdicts were consistent with the evidence, or as it was revealed in this matter, lack of evidence, and an innocent man is now free to return to his eight-year-old little boy. Ultimately, justice was served.
