Our very own Tom Luebbering presented a CLE titled "Can Intellectual Property Law Rein in AI?" to nearly 200 attorneys at the Johnson County Bar Association Bench/Bar Conference yesterday. This timely CLE covered the basics of AI models, how AI is testing the norms of patent and copyright practice, and what to expect in the future.

If you missed Tom's CLE presentation yesterday, you can catch him presenting again on May 17 at the Wichita Bar Association or on June 7 for the Topeka Bar Association.

We are deeply saddened by the recent passing of Rachel Nichols. Rachel has been a longtime legal assistant at Hovey, but more importantly, she is Hovey family. She will be dearly missed by all of us.

Our office will close early this Friday (March 22) at 11 am, so that all Hovey employees can attend Rachel's memorial service. We will reopen for regular business hours on Monday, March 25.

We extend our deepest condolences to Rachel's family and friends.

USPTO Provides Guidance for Inventorship Determination of AI-Assisted Inventions | Hovey Williams LLP 02/27/2024

Partner Tom B. Luebbering has authored an article on the recently released USPTO guidance regarding AI, inventorship, and patentability.

"The guidance acknowledges the challenges in determining inventorship for AI-assisted inventions, particularly when the inventive process involves collaborations between humans and AI systems. It encourages patent applicants to provide detailed explanations of the roles played by both humans and AI systems in the inventive process when filing patent applications."

U.S. SUPREME COURT GRANTS CERTIORARI TO RESOLVE CIRCUIT SPLIT REGARDING COPYRIGHT DAMAGES - Kenzie Lawrence

Two appeals courts, a California-based Ninth Circuit and New York-based Second Circuit, have been split over a key time frame established by the Copyright Act, leading to one essential question—Can a copyright holder recover for infringements that occurred more than three years before the filing of a lawsuit? After a Florida-based Eleventh Circuit recently ruled “yes,” siding with the Ninth Circuit and widening the circuit split, the Supreme Court granted certiorari to clarify the damages period under the Copyright Act.

In the case at hand, musician Sherman Nealy and his company sued for copyright infringement that occurred as early as 2008. However, Nealy claimed he did not learn of the alleged copyright violations until 2016, and filed his suit less than three years later, in 2018. Under the Eleventh Circuit’s ruling, Nealy can seek relief for the infringement dating back to 2008. However, if the Second Circuit’s ruling were applied, Nealy’s relief would be limited to infringements within three years of filing the lawsuit.

It is not surprising that the states where these disputes have arisen are prominent artistic hotspots, as the Supreme Court’s ruling in this case will have an impact on copyright holders including musicians, artists, authors, and other creatives. The ruling will play a pivotal role in shaping the scope of recoverable damages for infringements. It will also reduce forum shopping, impact incentives for pursing litigation, and affect the cost and time investment associated with copyright infringement claims. Ideally, the Supreme Court’s decision will maintain strong protection for copyright holders while fostering uniformity and greater predictability under the Copyright Act.
