AMS is reevaluating (for mandatory "GMO" disclosure) the electronic or digital link disclosure option and is soliciting public input. Commenting parties should submit responses to questions 1 through 8 below and provide data and other evidence (if available) to support any suggested revision.
(1) What are the current challenges associated with consumers accessing information on the BE status of foods by electronic or digital link disclosure in a retail setting?
(2) what additional and comparable option should AMS add to the electronic or digital link disclosure option that would be more helpful for consumers? In which location proximate to the electronic or digital link should an additional and comparable option be placed?
(3) Provide information on current smartphone ownership among consumers if available.
(4) Provide information on the availability of broadband in a retail setting, if available.
(5) Provide current information on the consumer usage of BE or other electronic or digital link disclosures in a retail setting.
(6) Explain any advantages and benefits to using the electronic or digital link disclosure option.
(7) Provide any information available on the percentage of usage for each of the four current disclosure options. In addition, provide information on how many small businesses use each of the four disclosure options.
(8) How long does it take on average to update label art, print new labels, and deploy new labels to production lines? How frequently are labels reordered and label inventory updated? Is there any standard cycle for updating retail product labels? How frequently is product inventory updated at retail? What is the preferred optimum compliance period for incorporating new mandatory disclosure information into products for retail?

Availability of Draft Supplemental Guidance on Menu Labeling FDA is announcing the availability of a draft guidance for industry entitled Menu Labeling: Supplemental Guidance for Industry (Edition 2).
the draft strategy highlights actions that the FDA, USDA or EPA could take. Examples of specific FDA actions include:
- FDA and USDA will contribute date labeling and food safety advice to inform EPA’s national consumer education campaign.
- FDA will continue working with the food industry to advance the goals under the FDA New Era of Smarter Food Safety initiative to support and encourage supply chain stakeholders to adopt and leverage tech-enabled digital tracing technologies to remove contaminated foods more rapidly and accurately from the marketplace, while simultaneously reducing food loss and food waste associated with contamination events.
- FDA will continue to encourage uniform adoption of food donation practices updated in the Food Code, which provide consistency and uniformity for public health officials.

The SECG is aimed at food manufacturers producing yogurt products for the U.S. market and restates, in plain language and in a question-and-answer format, the provisions in the final rule. It includes the following questions, among others:
What did we change for yogurt products?
How does the rule describe “yogurt”?
What are the pH requirements for yogurt?
What are the requirements for milkfat and milk solids not fat?
Are there different requirements for producing reduced fat, lowfat, or nonfat yogurt?
What sweeteners may you use in yogurt?
Manufacturers must begin complying with the rule for products labeled on or after January 1, 2024.
