HB 1125 CALL TO ACTION!!
This bill continues to be amended, and not for the good of South Dakotans who rely on getting legal, h**p derived cannabinoids from local stores. During the Senate Health and Human Services committee HB 1125 was amended again back to it's original form with small changes that the people backing the bill argue will protect non-psychoactive products like CBG and CBC, but this language is too vague and the bill leaves the door open to more bans in the future. HB 1125 in it's current state, amended to remove the amendment that unanimously passed the house and we fully endorsed, will effectively kill the CBD industry in South Dakota as we know it. It will effectively ban the sale of naturally occurring, h**p derived cannabinoids such as CBN, CBC and Delta-8, though it says nothing about possession. Therefore brick and mortars will be criminalized for providing products that will otherwise be available online.

An amended version of HB 1125 was presented and UNANIMOUSLY passed the House today! As you know, we opposed the original version of the bill. So, what's different now? Let us explain!
Originally, HB 1125 would have eliminated all legal h**p products in South Dakota. This amended version goes solely for cannabinoids produced synthetically through means of acetylation, such as Delta 8 THC-O. We are in full agreement with our State House on keeping h**p natural and safe. Those who shop with us are aware that we moved away from acetylated cannabinoids in 2023 following guidance from the DEA. We're more than ready to close this loophole, and this part is where YOU come in.
We are asking our customers, their loved ones, and any South Dakota h**p consumers reading this to please reach out to your district representatives again. Let them know that you support HB 1125 as amended. This bill will be heard again in the Senate, so we aren't through this just yet! However, today was a major win in our books.

Black Hills CBD spoke as the sole opponent of HB 1125 in Pierre this morning. Getting 11 yeas on a bill that no one in the room came close to understanding was incredibly disheartening. Luckily, sharing our love and knowledge for CBD, and the other amazing cannabinoids in the h**p plant, is kind of our thing. We will be at the next hearing. This hasn't been scheduled yet, but we will continue to update you all.
What we need now, to protect access to legal h**p in South Dakota, is exactly what we've been asking of our customers over the last couple weeks: CONTINUE CONTACTING YOUR DISTRICT REPRESENTATIVES! We have seen posts directing consumers to contact the Prime Sponsors of the bill. While you have a right to contact any elected official, they have a right to ignore your argument if you do not reside in their district.

UPDATE: HB 1125, as it is written, would also ban non-psychoactive cannabinoids such as CBD, CBG, and CBN.
This is no longer an argument between psychoactive, and non-psychoactive cannabinoids, (AKA intoxicants and non-inxtoxicants) and therefore, becomes a fuzzy and extremely misguided argument for concern from our State House + Senate.
Even if you hold an MMJ card, take notice in how our state is attempting to roll back long-standing h**p laws. Realize that it could be you on the receiving end, that it HAS been ALL SD H**P VOTERS in very recent history!

BH CBD patrons, and h**p consumers of South Dakota,
A new bill to ban Delta 8, HHC, THCP, and other naturally occurring cannabinoids is being drafted to be introduced. This bill aims to eliminate the sale of legal h**p products by small businesses in South Dakota. Luckily, the dispensary owners advocating for these bills have had little luck so far; however, the fight is not over.
Write to the legislators in your district and speak out against the attempt to restrict access to legal h**p-derived cannabinoids. There is no need to allow them to control another market that is already regulated for 21+.
South Dakotans passed the h**p laws with the intent that isomers and salts are perfectly legal as long as they have below 0.3% THC. By rewriting this law, these cannabinoids that many have come to use daily will no longer be available, forcing the users to get a medical card, which is the ultimate goal for them to make more money, and cornering another market.
This will stifle the consumer's ability to choose which product best suits their needs and limit their ability to support their favorite local stores.
Small businesses have enough to worry about as is. South Dakotans deserve the right to have access to legal h**p isomers, as the current law states. There is no reason to change that other than greed and control.
