If you have been paying attention to the news in the last week, you have heard the reports that the National Association of Realtors (NAR) has settled the class action lawsuit against them. While that is true, don’t believe all the doom and gloom headlines created by the national news media to generate attention and clicks. While the case still needs to get signed off by a judge, I wanted to share some of my thoughts about what happened and what it potentially means for you.

If and when the ruling gets finalized, it does not necessarily change the overall concept of how real estate is bought and sold in MN for the simple fact that commissions have always been negotiable. In Minnesota, we already had buyer representation agreements and broker compensation disclosures for both buyers and sellers. It seems normal to us here in Minnesota as we are 1 of 19 states that have these forms. Part of the settlement means that 31 other states are now catching up to standards that we had already been following.

Yes, a few other changes are coming to the real estate industry. When finalized, Real Estate Agents will no longer be able to offer/advertise commissions or compensation in the MLS. Most likely there will be alternative ways to display or find the information so the impact of this is inconvenient but at the same time fairly minimal. As always, buyers will have the choice of real estate representation.

The good news is that the real estate industry is going to get better as a whole. These changes will now mean agents need to justify and explain their compensation/commission to customers/clients early on in the homebuying and home-selling processes. Agents like myself have already been doing this and now it raises the bar for everyone else in the industry.

I have had the good fortune of meeting many amazing real estate professionals over the years. I know that truly dedicated professionals will continue to guide clients through their real estate transactions with invaluable expert advice. More than ever, I truly think it is going to matter who you hire when looking for representation as a buyer or seller. My advice is to consider what that agent brings to the table in terms of experience, reputation, connections/network, marketing, problem-solving ability, dedication, and the ability to give 100% of their attention to you and your needs. Above all else, look to someone you trust or can earn your trust. Buying or selling a home is not only a big financial investment, it is an important and meaningful decision in the lives of the people involved. I am looking forward to doing my part to make a positive and impactful change in the real estate industry. Let’s GO!
