I often tell clients that creating a Trust is like building the foundation of a house. Once the foundation is set and strong, the rest of the house can be built. Over time, additions can be made, walls can be knocked down and the house can be re-designed.

A Trust is foundational to protecting you and your family in the event of the unexpected. Once the foundation is set, assets can be moved in and out of the Trust throughout your lifetime.

Without a strong foundation, you are standing on quicksand 😑

On this Independence Day 2021, I applied FREEDOM to my own life! I did it... I retired myself from a nearly 15 year career in law enforcement to expand my law practice here at Deterding Law.

This decision did not come lightly, nor was it something out of the blue. It was a crossroads in my life and I had to decipher between my head and my heart. I guarded this decision for months, simply because not every piece of advice is good advice. I sought advice from people who are living the life I seek to live. A life full of choices, presence, design and independence.

Law enforcement gave me strength, bravery and honor. I gave law enforcement my full commitment for a decade and a half, and I am extremely proud to have walked that path with some of the most extraordinary humans I have ever met... and many whose friendships will last a lifetime.

Now I can serve my community in an exciting and expansive way by protecting more families through Wills and Trusts. My heart is so full 💙

Estate Planning Isn't Only About Death:

Statistically speaking, a young parent is much more likely to become disabled because of a disease or accident, than they are to pass away. A great estate plan incorporates disability planning as well as planning for an untimely death.

Estate planning lawyers can prepare powers of attorney and health care directives that arrange for someone to take care of your affairs if you should ever become mentally incapacitated (by injury, illness or any other circumstance). Powers of attorney give someone you trust the ability to sign in your name if you become unable to. You can also make a health care directive to assign someone the ability to conduct your health care wishes if you're unable.

Many parents believe that their “responsible” children do not need the protection of a trust. After all, if your child is good with money, why do they need their inheritance placed in a trust?

A trust can provide five main protections that won’t be present if you give assets to your children outright: (1) creditor protection, (2) predator protection, (3) divorce protection, (4) self-protection, and (5) estate tax protection.

A will is a great place to start, but it's only the beginning.

For most of us, a will just won’t cut it. Young kids, incapacity, privacy. These are all things covered in a trust, and often left out of a simple will.

While many wills or trusts identify a guardian for your children in your absence, some don’t. If you have minor children or are considering having kids, picking a guardian is incredibly important and sometimes overlooked. Make sure the individual or couple you choose shares your views, is financially sound, and is genuinely willing to raise children. A backup guardian should be named as well.
