A common question that divorce clients ask me is "when is my case going to end?" The truth is, it is very hard to say. One thing is for sure, it doesn't end after six months like many people think. Six months is just the minimum amount of time that a court can enter a Judgment of Dissolution in California. Many cases take longer. Cases end when the reach an agreement on all issues in the case or there is a trial where a judge makes all the decisions. Due to the uncertainty of trial, stress, privacy concerns and very high cost, most folks reach a voluntary settlement. In fact, it's about 97% in California. However, that doesn't mean a settlement comes quickly or easily. For Arnold Schwarzenegger and Maria Shriver it took ten years! In my experience, one to two years is more typical unless the case is very simple or very complex. Very tragic and sad. It's also a troubling example of the limits of a restraining order. In case you are unaware, when a restraining order is granted, the restrained person must temporarily or permanently relinquish their guns. This must be done within 24 hours of receiving the order.
