What is the Trade Agreements Act (TAA)?

The Trade Agreements Act (TAA) of 1979 was enacted to foster fair and open international trade.

Under TAA, the products and/or services offered on a GSA Schedule contract are required to be only U.S. made or TAA designated country end products. Government buyers are assured of making good decisions with their equipment purchases to avoid implementation of equipment that are of grave risk to national security from foreign players.

GSA contract holders demonstrate good ethical business practices and a commitment to their government customers by selling TAA compliant items. Plus, it keeps you out of jail.

What is the National Defense Authorization Act (NDAA), specifically Section 889?

Section 889 of the John S. McCain National Defense Authorization Act prohibits government contractors from providing the federal government with telecommunications or video surveillance equipment, systems, or services produced or provided by one Russian entity and five Chinese companies and their subsidiaries and affiliates.

Separately, Section 889 prohibits government contractors from using these prohibited items or services, regardless of whether they are used in the performance of work under a federal contract.

GSA has created a category called Order-Level Materials (OLM) which are supplies and/or services acquired in direct support of an individual task or delivery order placed against a GSA MAS contract.

You can leverage the OLM SIN on all your contracts. This enables you to quote items that are not on contract.
✅You must track, label, and quote all your OLM items.
✅You must report OLM items and pay the Industrial Funding Fee (IFF).
✅Total of the OLM items cannot exceed 33.33% of the value of the contract.
✅OLM’s cannot be sold alone.
