FYI: Mandatory Paid Family Leave
On March 18, 2020, President Trump signed the Families First Coronavirus Response Act. The act contains provisions for:
• Mandatory paid family leave;
• Mandatory medical and emergency paid sick time;
• Employer tax credits for employers who must pay for mandatory paid family leave and mandatory medical and emergency paid sick time; and
• Credits for self-employed taxpayers to provide them with comparable benefits against their self-employed income.
Generally speaking, these rules apply for all businesses with fewer than 500 employees. There has been some discussion to exempt those with fewer than 50 employees, but that is uncertain at this point.
This letter focuses on the last two items in the list above: the employer and self-employed tax credits. We will be sending you a separate letter to help you understand your obligation to pay family leave and medical and emergency sick time to your employees due to the coronavirus (COVID-19).
You will be eligible to receive two payroll tax credits for wages paid to employees when you are required to pay for family leave or medical and emergency sick time. The payroll taxes that are available for retention by the employer (they don’t have to be paid over to the IRS) include federal income taxes withheld from employee gross pay, as well as the employer and employee’s share of Social Security and Medicare taxes. Any excess credits will be refunded after filing your quarterly payroll tax returns.
It will be imperative for employers to maintain detailed payroll records regarding paid time off due to the coronavirus. You will need them when preparing your payroll tax returns.
Mandatory paid family leave
The employer credit for wages paid for mandatory paid family leave is equal to 100% of the wages paid to each employee, limited to $200 per day per employee with a maximum credit of $10,000 per employee.
Credit for wages paid for medical and emergency paid sick time
The employer credit for wages paid for medical and emergency paid sick time is equal to 100% of wages paid to each employee, limited to $511 per day for employees who are sick and $200 per day if the employee is caring for a sick family member or a child who is at home due to a school closure. The credit for emergency paid sick time per employee is limited to 10 days in total.
If you are self-employed, you are also eligible to reduce your self-employment tax. The provisions for self-employed taxpayers are designed to mimic the provisions applicable to the employer payroll tax credits, and we will be able to compute these credits for you when we file your personal income tax return.
This law has some complexities, and we are happy to work with you to make sure you get every benefit you are entitled to.

The President has signed the biggest tax reform law in over 30 years. When you file your 2018 tax returns — about a year from now — your tax return will look very different. And because most changes don’t happen until then, we have some time to learn about the changes and plan for next year. Here are a few of the biggest changes that may affect you.
Tax rate changes: Both individual and corporate rates have changed. The maximum individual rate is reduced to 37% and the corporate rate is now a flat 21%. The rate change could benefit you — or in some cases cause your tax liability to go up.
Standard deduction increases: However, there are no more personal exemption deductions allowed. So this may help you — or hurt you.
Increased Child Tax Credit and new Dependent Credit: The credit is increased for each child to $2,000 (up to $1,400 of which is refundable for each child) and each non-child dependent can now receive a new credit of $500. But you will have no exemption credit or deduction for yourself, your spouse, or your dependents.
The phaseout thresholds for these credits are drastically increased. Married taxpayers filing a joint return can claim the full credits if their adjusted gross income is $400,000 or less ($200,000 for all others). The credits are fully phased out for married taxpayers filing a joint return when their adjusted gross income reaches $440,000 ($240,000 for all others). This means that many more taxpayers will be able to claim these credits in 2018 and beyond.
Disappearing deductions: Beginning with the 2018 tax year, you will no longer be able to deduct:
• State income tax and property taxes above $10,000 per year in total;
• Moving expenses (with an exception for certain military);
• Employee business expenses such as mileage, travel, entertainment, home office expenses, union dues, tax preparation fees, and investment fees, among others;
• Mortgage interest beyond interest on $750,000 of acquisition debt, if you purchase a new home; and
• Mortgage interest paid on equity debt (this is no longer deductible for any taxpayers).
Some new benefits for individuals: These new benefits include:
• The medical expense AGI threshold will temporarily drop to 7.5% of AGI for 2017 and 2018;
• The AMT threshold is increased, so fewer middle-income taxpayers will be subject to AMT;
• The estate tax exclusion has nearly doubled, to $10 million (adjusted for inflation); and
• The annual gift tax exclusion remains the same ($14,000 for 2017 and $15,000 for 2018), but the maximum rate on gifts is 35%.
Small business benefit: Beginning in 2018, there will be up to a 20% deduction from net business income for a sole proprietorship, LLC (excluding those taxed as a C corporation), partnership, S corporation, and rental activity. The rules are incredibly complex but there is a lot of planning that we can do to maximize this deduction for you.
These are the most common changes, and at your tax interview this year we will discuss any other changes that might affect you. As these changes are not simple, we suggest a separate appointment to go over the changes that apply to your situation and to talk about how to maximize your tax benefit.

You have undoubtedly heard about the federal “tax reform” bills passed by the House of Representatives and the Senate and now going to Conference to make one bill out of the chaos. There are two deductions items that are up-in-the air at this time, both very important to California taxpayers.
First is the deductibility of real estate taxes on personal residences. One version would eliminate this deduction completely; the other version would limit the deduction to a maximum of $10,000. The date of actual payment governs when an item is deductible. You may want to pay the second installment of your real property taxes (normally due 4/10/18) before 12/31/17 to be deductible in 2017. If this is your desire, make sure you get the payment posted before 12/28/17.
Second is the matter of the deductibility of state income taxes. At this time both bills make state income taxes non-deductible in 2018. You may have a California estimated tax installment due 1/16/18 for 2017 taxes. If this is paid before 12/31/17 it will be deductible in 2017. Again, make sure you get your payment posted before 12/28/17.

The beginning of the school year is a good time for a reminder of the tax benefits for education. These benefits can help offset qualifying education costs.
Here is information about two tax credits available to those who pay higher education costs for themselves, a spouse or a dependent.
The American Opportunity Tax Credit (AOTC) is:
Worth a maximum benefit up to $2,500 per eligible student.
Only available for the first four years at an eligible educational or vocational school.
For students pursuing a degree or other recognized education credential.
Partially refundable. Eligible taxpayers can get up to $1,000 of the credit as a refund, even if they do not owe any tax.
The Lifetime Learning Credit (LLC) is:
Worth up to $2,000 per tax return, per year, no matter how many students qualify.
Available for all years of postsecondary education and for courses to acquire or improve job skills.
Available for an unlimited number of tax years
Taxpayers should use Form 8863, Education Credits, to claim these education credits.
Additionally:
A student is required to have Form 1098-T, Tuition Statement, to be eligible for an education benefit. They receive this form from the school attended.
Taxpayers may use only qualified expenses paid to figure a tax credit. These include tuition and fees and other related expenses for an eligible student.
Eligible educational schools are those that offer education beyond high school. This includes most colleges and universities.
Taxpayers may only claim qualified expenses in the year paid.
Taxpayers can’t claim either credit if someone else claims them as a dependent.
Income limits could reduce the amount of credits.
Taxpayers can’t claim either the AOTC or LLC for the same student or for the same expense in the same year.
The Interactive Tax Assistant tool on IRS.gov can help determine eligibility for certain educational credits including the American Opportunity Credit and the Lifetime Learning Credit.

If you want an automatic 5-month extension of time to file the return and provide Schedule K-1 or a substitute Schedule K-1, file Form 7004. Then, file Form 1065 by September 15.
