USCIS just came out with some more details on filing a Keeping Families Together application for Parole in Place for spouses and step-children of U.S. citizens, who have been in the U.S. continuously since June 2014, without having been admitted or paroled. However, the fine details are not yet out. Those should be available by Monday, August 19, 2024. I'll be accepting new clients for this Biden program starting August 26, 2024. I am working with my current clients to get their applications filed.

I am still waiting for final details from USCIS about the Keeping Families Together program. Part of it is for spouses of U.S. citizens who were married on or before June 17, 2024, have been here at least since June 18, 2014, and who have no criminal history and who entered the U.S. without a visa. Step-children from that marriage may also be eligible. Applications open for filing on August 19, 2024, so we should have fine print soon. As soon as we do, I'll be accepting new clients for this type of application. It would allow those eligible to remain in the U.S. to apply to obtain their permanent residence (green card).

Because filing fees are going up, there will be a increase in filings with USCIS before the fees change on April 1, 2024. That also means that if you file just before or anytime after that deadline, you can expect longer processing times then the currently posted ones.
January 30, 2024 - USCIS fees will be increasing on April 1, 2024. USCIS must have received your application or petition by March 28, 2024, for the current fees to apply. In order to assure that I have time to file your application or petition before the filing fee increase, please assure that I have received all of your documents by March, 12, 2024. Those received after that date, I may be able to file in time, but I may not. For those applications or petitions, I will file in the order that I received all of the documents required to file.

For those foreign nationals who have been in U.S. since December 2000 or earlier AND had a relative or employer file a petition for you or one of your parents, on or before April 30th, 2001: you should be checking the Visa Bulletin monthly as it inches closer to the final priority dates for 245i. When your priority date finally becomes available, you will want to apply immediately for your green card.
