Attention Missouri Process Servers. There has been a rule change regarding substitute service. The age for a person to accept service has changed from 15 years of age to 18 years of age effective 12/1/2021

54.13. Personal Service Within the State

(a) By Whom Made. Service of process within the state, except as otherwise provided by law, shall be made by the sheriff or a person over the age of 18 years who is not a party to the action.

(b) How and on Whom Made. Personal service within the state shall be made as follows:
(1) On Individual. Upon an individual, including an infant or incompetent person not having a legally appointed guardian, by delivering a copy of the summons and petition personally to the individual or by leaving a copy of the summons and petition at the individual's dwelling house or usual place of abode with some person at least 18 years of age residing therein, or by delivering a copy of the summons and petition to an agent authorized by appointment or required by law to receive service of process.

Got a call today from a rep from IDI who wanted to answer questions regarding my concern about their sudden inspection requirement and the cost being paid by me and other process servers.

She advised that this requirement allegedly just came down from whomever provides them with this data. I expressed my concern about someone coming into my house who I do not know and do not know whether they have been exposed to COVID or are an active carrier. Her response was generic and provided no real answer as to how/if these contractors that are being sent out are being screened for the illness prior to coming to someone's house. She also told me that if I agree to spend a certain amount per month with them they would give me a credit for half of the inspection fee.

My impression is their concern is phony. They want you to commit to the inspection and that is their only concern.

I don't believe the inspection itself is a big deal necessarily but the way it is being done and the vendor having to pay is.

All contracted process servers of ABC Legal need to turn their availability to the off position in the ABC app for one week in protest of their ridiculous expectations.

Just received a couple of jobs from ABC Legal after the COVID crisis. They made changes to their app so that you can see what attempt parameters you need to meet. I noticed that the app states up to 7 attempts in no contact scenarios. The contract I signed in Missouri said 4 attempts max. I advised them I would honor my contract and make the four attempts but not seven.

Anyone that is serving for them should check the app to see if they tried to sneak that in in other states as well.

Attention NAPPS members: When you post a job for service make sure that the information is correct. Don’t post one set of docs for service when really it is two. Even if it is at the same place it is still two serves that require affidavits to be completed. No I won’t do them both for the price I initially quoted because the number of docs to be served was not correct.
