I have had this conversation with many clients about the new changes hitting our industry, hopefully this can help anyone and everyone to understand.

Did you know that starting August 17th a realtor can no longer show you a property without a signed buyer’s agency agreement? It can be exclusive or non but it must be signed. This means we cannot even unlock the door without it, if we do, we can accumulate costly fines.

A buyer’s agency agreement legally binds you to that particular agent for an agreed-upon timeframe, spells out their compensation, and details their duties to you.

Potential buyers must actually commit to hiring that buyer agent for a determined amount of time.

This will hopefully help a buyer to decide on which agent will perform their duties from negotiation, due diligence, communication, and hard work to achieve the buyers goals.

Yes, sellers can still pay a buyer’s agent commission, but it’s no longer listed in the MLS. (And we expect that to happen 95-99% of the time)

Now, buyer’s agents must communicate with listing agents to explore if the seller is offering commission and the amount offered.

We have always practiced this way. We have always asked our buyers to sign agency and hire us knowing that our compensation would be paid by them if the seller wasn’t offering compensation. They hire us for our knowledge, expertise and experience.

In any profession, hiring the best person for the job can save you from making errors that could cost you thousands moving forward.
