VA DISABILITY CLAIMS & APPEALS
SERVING ALL BRANCHES OF THE UNITED STATES MILITARY
If you believe that the symptoms you are experiencing are a direct result of your time in the service, then filing a disability claim is your best option. There is no reason why you should continue to suffer without just compensation. But what can you reasonably expect?
What Can I Expect After Filing A Disability Claim With The VA - VA Claims Defender If you have questions, or need to file a VA Claim, we understand the complexities of the process. We are here to help you get the most from your claim.
Whether your rating was too low from the start or needs to be revisited as time has passed, we can assist in applying for an increased monthly veterans’ disability benefit based on an increased disability rating.
VA Claims Defender - Law Office Jocelyn C. Stewart Veterans who have been injured deserve what they earned through the sweat of their sacrifice. Let us help you get the benefits you deserve.
- What if I didn’t get treated for my disability while I was in the military?
Answer: The VA may deny you service connection for a disability, by finding that service treatment records did not show treatment for the disability. However, the VA cannot deny you service connections simply because you did not seek medical treatment while in service, unless treatment would have been required for the type of disability you are claiming. So, if your disability was one that did not necessarily require treatment, or if you did not realize you had the disability at the time (as is often the case with sleep apnea), The VA is not supposed to count this failure to seek treatment against you.
Veterans deserve respect, and veterans who have been injured deserve what they earned through the sweat of their sacrifice. Let us be the ones to ensure your service is valued with dignity and respect.
We provide effective zealous representation.

Years of firing weapons without adequate hearing protection can cause ringing in the ear syndrome also known as tinnitus. If you experience high pitched ringing in your ears or hear sounds that don’t exist externally such as clicking, roaring, humming, or hissing you could qualify for Veteran Affairs benefits.
What’s The Highest Rating For Tinnitus? - VA Claims Defender If you've already rated for conditions such as TBI, hypertension or even PTSD, but not for tinnitus, it may make sense to put in a claim for tinnitus.
Let us be the ones to ensure your service is valued with dignity and respect.
- How do I prove an event in service if it happened while I was in combat?
Answer: The VA recognizes that most combat related injuries are unlikely to be shown in the medical record, due to the conditions of combat. Therefore, as long as the event or evidence are consistent with the circumstances, conditions, or hardships of service, the VA is supposed to take your word that the event did happen, even if there was no record of it.
VA Claims Defender was founded to help former soldiers obtain the disability claims they rightfully deserve.

First and foremost a disabled veteran needs to have a service-related disabling medical condition that qualified for a VA disability compensation rating. The amount a qualified disabled veteran can receive in a disability benefits ranges from zero to 100%. A 100% disability rating denotes a medical condition that is totally and completely disabling with no expectation of finding gainful information.

- What if my claim was denied because my military records are lost?
Answer: The VA often denies claims due to lost military records. This denial is usually accompanied by statement saying that if the records are eventually found, The VA will reconsider its decision. However, The VA should not deny your claim simply because records are lost through no fault of your own. In the instance of lost records, the VA has a “heightened” obligation to more fully discuss the reasons and bases for its decision and to carefully consider applying the benefit-of-the-doubt doctrine.
Those who served know the battle of dealing with Government paperwork. And when you’re dealing with injuries or medical conditions, paperwork is not something that is enjoyable even on the best of days. Our goal is to simplify that process and get those that need those benefits a renewed sense that people care.

You spent years defending the freedoms of others as a soldier, you know how to fight. Unfortunately, off the battlefield it’s a different story. Hundreds, if not thousands, of hours were devoted to making you the finest soldier you can be…and not once did the system train you to be disabled. Nor did they train you to deal with the countless hours of paperwork dealing with your disability.
Why Hire An Attorney For Your VA Claim? - VA Claims Defender The main advantage of hiring an attorney is they dont rely on the VA to gather information of evidence to support your disability claim.
Did you know if you do “win” you’ll receive the increase based on when you file, so it’s better to file sooner than later?

- Will my statements, or “buddy” statements, help my claim?
Answer: Statements by you, a loved one, or a buddy, can help your claim. Although lay statements typically are not sufficient to link your disability to service, or to diagnose your disability, the statements are sufficient to establish the onset and continuity of symptoms. This means the VA is supposed to take your word regarding the history of your symptoms and when your symptoms began. Along with the statement of your current symptoms, a VA examiner or private examiner may diagnose a current disability, and may provide a link between your current disability to military service. The VA is required to review lay statements regarding the veteran’s disabilities.
Our Mission: Remain always motivated, prepared at every stage, and only take action only after considering the best strategy on how to proceed in any given case.

Did you know that experience counts? A thorough evaluation by experienced VA law experts won’t hurt and can only provide insight.
- Will an independent medical opinion (IMO) help my claim?
Answer: An opinion from a private medical provider linking your disability to service, or confirming a current diagnosis, can be helpful. However, these opinions can be very expensive. You should approach any agreement with caution and a clear understanding of what you will eventually owe. Additionally, it is rare for the VA to not provide their own medical examinations. So, just because you provided your own examination report, this does not mean that the VA won’t examine you themselves.
Our Vision: To always be where we can do the most good.

- What do I do if the VA examiner is not qualified?
Answer: If you have any reason to think that your VA examiner is unqualified, you should submit a statement to the VA explaining why. The VA will presume that the examiner is competent to perform the exam, unless you raise the issue of competency.
We welcome the opportunity to assist veterans in their VA Claims appeals. It should not be this hard to obtain what you are owed. Let us take the guesswork out of the process; entrust us to guide you, and to leverage all possible avenues for your increased relief.
