Listing Agent (LA) a.k.a. Seller's agent and Selling Agent (BA) a.k.a. Buyer's agent are both licensed Real Estate professionals that have a fiduciary duty to their clients that they represent.

The LA represents the seller and the BA represents the buyer. An agent is called a Dual Agent if he/she is representing both parties in the transaction and must be disclosed to each client before forming a contract.

There was a time when there was only a Real Estate Agent. No LA, no BA. However, when selling a house, the agent's duty is to get the seller the highest and best offer. By also representing the buyer in the transaction, that agent may or may not be going against the fiduciary duty to the seller. This creates a conflict of interest that resulted in various lawsuits.

💬 Ask yourself these questions when hiring a Real Estate agent. 💬

Will my agent have my best interest at all times?
Will my agent be loyal to me as a client?
Will my agent treat my information with confidentiality?
Will my agent provide care and diligence?
Will my agent practice obedience, not just to me but to the law as well?
Will my agent disclose to me any known facts pertaining to the transaction?

If you answer NO to any of the questions, it is time to find another agent that will and can practice his/her fiduciary duty to you as a client.

Buyer Credit Score Tip!

Your FICO score consists of:

35% payment history. Pay your credit accounts on time. If you're in a tight spot before the billing date, pay at least the minimum to avoid a penalty.

30% Amount Owed. Keep your credit usage to less than 30%. If you can, pay it down to lessen your interest.

15% Length of Credit History. Don't close a credit account, especially your longest one. Lenders wanted to see that you are in good standing with other lending institutions.

10% New Credit. Did you open a new credit account recently? Applied for a new credit card? Financed a car? Purchased a big furniture?

10% Credit Mix. This includes credit cards, retail, mortgages, student loans, etc.

Aside from your credit score, it is smart to check your credit health at least once a year.

There are free resources such as www.annualcreditreport.com for you to monitor your credit health. The website allows you to view the Big 3 (Experian, Equifax, and Transunion). You can view them all at once or check each one every quarter.

Getting your credit health in good shape is a must when buying a home.

Also, consult with a credit professional if you have any concerns about your credit.

Always start with the lowest offer on a home. MYTH!

I know that as a buyer, we wanted to get the house at the lowest price possible. However, it is sometimes not a good indicator (remember, you get what you paid for) if the seller side sells it to you for less than its market value.

It's best to rely on your trusted Real Estate agent to form a strategy and make you a winning offer.

It's National Just Because day BUT if you're a BUYER don't skip this contingency Just Because.

When buying a home, you want to make the right choice, be confident with your decision, and not be part of the 39% who bought during Covid-19 that felt remorse.

One thing you shouldn't be doing Just Because is waiving your Home Inspection. As a buyer, you wanted to find out what repairs that need to be done (this includes, plumbing, roof, foundation, electrical system, HVAC system, and more) before closing on that home you love. Home inspection contingency also gives you the option to back out if you find something unfavorable to you regarding the safety condition of the house. Note: You cannot back out Just Because.

We are past the time when buyers are waiving contingencies left and right. Unless you're an investor or have the money to fix the house, don't.

Better yet, talk to your trusted Real Estate agent to help you weigh your priorities and find out more about home inspection.

Going FSBO (For-Sale-By-Owner) might seem like you're saving money, but are you really?

According to Collateral Analytics, a real estate analytic product company, FSBO homes sell for an average of 5.5% less than comparable homes with agents.

It's important to note that most buyers will be represented by an agent. In 2021, 87% of buyers bought with a broker or agent — so you'll still need to offer the standard 2-3% commission or else agents won't be motivated to show your property.

That 5.5% more than wipes out the 2-3% seller's agent commission, so you'll need to be extra careful with pricing your home and negotiating concessions.
