Is That National Labor Relations Board Constitutional? - Is That Even Legal? 05/07/2024

Is the National Labor Relations Board (NLRB) unconstitutional? I talk with John Balitis about the new challenges to the constitutionality of the NLRB. The current composition of the U.S. Supreme Court may allow for new challenges to the NLRB. Is this a good thing? Listen in.

Is That National Labor Relations Board Constitutional? - Is That Even Legal? Bob is fascinated by the balance between the need for regulation and the vast growth of the administrative state. We are also fascinated by just how much the political winds impact the law…even though we like to believe it is solid and hard to change. Look no further than the 88-year-old National ...

I was interviewed on ABC regarding the Insurection Clause of the 14th Amendment and the case before the Supreme Court involving whether Trump should be disqualifed from the ballot. This is a case to watch.

Examining the 14th Amendment's Insurrection Clause and Its Impact on Trump's Political Future - Is That Even Legal? 02/09/2024

I was interviewed today by Rachel Louise Just, with ABC15 Arizona, regarding the Insurection Clause of the 14th Amendment. The case before the Supreme Court is one of the most consequential in modern history. The issues to be decided by the court are both simple and complicated all at once. I just published a podcast on the subject with Ilya Somin, constitutional professor, give him a listen here:

Examining the 14th Amendment's Insurrection Clause and Its Impact on Trump's Political Future - Is That Even Legal? No matter what side of the political spectrum you fall. And whether you think the former president should be on the 2024 ballot or not. Tomorrow's Supreme Court consideration of the Insurrection Clause is historic. We could not let it happen without taking a look. In this interview, Bob intervi...

The Supreme Court will review a decision from the 5th Circuit where the 5th Circuit held that it was unconstitutional for a person under a domestic violence protective order to be prohibited from possessing fi****ms. The impact of this case cannot be understated. I was asked to comment on Channel 3 News. Here is the story.

When I was in law school, I had a professor that used to drone on about how important grammar was to winning cases. I could not believe that cases turned upon the placement of commas, the meaning and use of colons, whether the legislature said “shall” or whether the legislature said “may,” etc. This week I won round 1 of a case (we have more suits coming) based on whether the legislature used “and” in the conjunctive sense in a statute. Who said lawyering was boring? ;-)

Groff v DeJoy is a case that has people in knots. One side of the country sees the opinion as a conservative Supreme Court forcing its religious values on us, while the other side of the country see it as a return to our religious Christian roots. The fact is the case is none of these things. The case involves intrepretation of Title VII of the 1964 Civil Rights Act, which requires an employer to accommodate an employee's religious practices so long as the practice does not create an "undue hardship" on the employer. Listen in at https://www.evenlegal.com/episodes/hardship-for-who-religious-accommodation-at-work-what-the-supreme-court-decision-means-for-you/to hear Jennifer C. Wassermann discuss how employers should think about the case.

Pet Waste Pandemic - Suing over poo. Unleashing law enforcement. - Is That Even Legal? 06/20/2023

I know this is a dirty subject. Frankly, the subject is a bit taboo, but we have to talk about it. Your neighbor sucks! He never picks up after his dog. The smell wafts over the fence and ruins your pool time. But did you know you can sue him for it? That’s right, you can sue over your neighbor’s dog's poo! You can also get your neighbor evicted for his dog’s excrement. Listen in while Marshall Hunt and I talk about the regulations, the fines, and the criminal law regarding your dog and it’s p**p. It may sound silly (and we do act a little silly), but if you have a dog, you should listen in.

AI is here, but are we doomed? Certainly, governments will have to act to regulate AI, but government actors are typically ill equipped to get ahead of any matter. Politicians are trained in rhetoric--they are masters in negotiation--but they are not typically experts in technology. Politicians are reactive and not proactive. I talk with Michael Carey about what changes we should expect to society, government and law. Mike is on the forefront of the issues we face in light of AI. Mike and people like Mike will need to lead the way on these issues. Check out what he has to say. https://www.evenlegal.com/episodes/are-the-robots-invading-your-privacy/.

Can The State Keep Your Kids Off Social Media? Should it? - Is That Even Legal? 05/04/2023

Social media is pernicious. We know that. It can damage our mental health and the mental health of minors, but should we ban it for minors? Utah did. There is some sense to this law. All soical media platform ask minors to contract to their terms and conditions, but minors cannot legally contract. However, privacy hawks believe this law will have negative effects to minors. This law should be watched as it progresses through rule making. I talk to Romaine Marshall to discuss the pros and cons of Utah's new law.

Interview with Arizona Attorney General Candidate Kris Mayes - Is That Even Legal? 11/02/2022

Who should I vote for? It's a question that concerns nonpartisan voters every election season. I had the chance to interview Kris Mayes, and Abraham Hamadeh, who are both candidates for Arizona Attorney General. I wanted to approach these interviews from an apolitical point of view. In large part, the goal was accomplished. We talked about real legal issues affecting Arizona. Kris gave me more time and, therefore, we covered more ground. However, both candidates had thoughts that surprised me. Listen to these interviews. Is your mind still made up? I wanted to explore election law. Election law feels overly complicated. Further, the discussion of election law is always mired in political craziness. To get to the bottom of things, I invited election law attorney Roy Herrera to discuss sign laws, voter IDs, and more.

Overturned! Major Court Decisions Can Instantly Change Decades of Law - Is That Even Legal? 08/18/2022

I wanted to explore what it means to be overturned. When the Supreme Court reverses decades of law, it tends to destabilize our society. Should we, as the consumers of the law, be worried? I talk on the podcast with Ilan Wurman, a constitutional expert, about what it means when the court overturns a law.
