some major changes are coming to the real estate market this week.

Did you know that starting August 17th a Realtor®️ can no longer show you a property without a signed buyer's agency agreement? It can be exclusive or non but it MUST be signed. This means they can’t even unlock the door 🚪 without it.
Doing so, and getting caught, results in thousands of dollars in fines. 💴💴💴💴
A buyer's agency agreement legally binds you to that particular agent for an agreed-upon timeframe, spells out their compensation, and details their duties to you.
There is no such thing as a "free service" for using a buyer's agent. Now, as with sellers, buyers must truly hire their agent.
Hiring an experienced agent that has done hundreds of transactions, and has many years of experience matters more than ever before.
Sellers always interview agents, and now … so will buyers, who must take this process more seriously.
🙌🏻Yes, sellers can still choose to pay a buyer's agent commission, but it’s no longer listed in the MLS.
Now, buyer's agents must call listing agents to confirm if and how much the seller will compensate. They will then communicate this to you, and you can decide how to proceed.
You can’t get an electrician or a plumber to come to your house for free. Their time is valuable and so is ours.
Educate yourselves so you aren’t in the dark when an agent explains this to you. A buyer's agent can offer valuable services and protect you from legalities that can cost you thousands.

I cannot keep my mouth shut about this any longer. I was going to until I saw a video clip about it from the President of the United States. This in regard to NAR's recent settlement involving commissions. This is NOT political...this is about right and wrong and facts vs downright lies / incorrect information. Here is the quote from POTUS:
“for the first time that Americans can negotiate lower commissions when they buy or sell their home. On a typical home purchase, that alone could save folks an average of $10,000 on the sale or purchase,” Biden added. “I’m calling on Realtors to follow through on lower commissions to protect homebuyers.”
Let's break this down:
1. Mr. President, if you don't know what you are talking about, please don't talk.
2. Consumers have always been able to negotiate commissions with Realtors.
3. News flash...this does not protect homes buyers! When we break it down, I don't think it protects homes sellers either, and I'll explain why...
4. We have a housing affordability problem in this country and it is not the fault of Realtors.
5. One of the first days of Realtor licensing classes, we learn about a little something called the Sherman Antitrust Act; we cannot price fix and get together with all of our Realtor friends to decide on what we are all going to charge our clients.
The Sherman Antitrust Act of 1890 is a federal statute which prohibits activities that restrict interstate commerce and competition in the marketplace. It outlaws any contract, conspiracy, or combination of business interests in restraint of foreign or interstate trade.
6. We do not inflate the price of homes to cover our commissions.
7. Sellers can still (and I do believe it is still in their best interest) offer buyer broker compensation (it just cannot be listed on the MLS anymore)
8. How is this going to help buyer's afford a home when I now have to explain to my buyer that they have to pay me out of their own pocket IF they want representation. Especially first time homebuyers who are struggling with affordability the way it is and are often using first time home buyer grant programs or down payment assistance programs. Now I have to say to them that if they want representation, they are going to have to come up with more money out of pocket.
9. I will not work for free, so do not ask me too. I work very hard for my clients to protect them and educate them through the entire buying process. How about this Mr. President....why don't you and everyone in Congress take a salary cut to help the American People?? I'm guessing that will happen when hell freezes over.
10. I will absolutely continue to suggest to my sellers that it's in their best interest to offer a buyer broker compensation. Why? If buyer's want representation but cannot afford to pay their Realtor out of pocket, they will likely not want to view that seller's home.
11. It potentially will not save the seller's any money. Why? They may pay less to list their home (if they choose), but they are going to turn around and potentially have to pay their buyer's agent on the other side...we call that 'a wash'.
12. For all of you that think we as Realtors only open doors, write up contracts and go to closing to pick up a check....I invite you to spend a month with me. Here is what a typical month looks like in my world:
a. I work, on average, 60 hours a week. I don't get a 'weekend'. b. I kill myself to pick up every phone call, text and email as quickly as I can. I have walked out of family dinners, events, movies, vacations... so that I can help my clients.
c. I often put my family on the back burner so that I can drop everything to go show homes to my buyer clients before they are sold in multiple offers.
d. I spend hours negotiating on my client's behalf (phone calls, meetings, emails, Zoom calls, etc...)
e. If there is an issue that comes up during the transaction, I am the one that spear heads making sure the issues gets resolved. ****Keep in mind...I am doing ALL of this without getting paid. I may work on a deal for months, have it fall apart and not get paid at all.
f. I don't get a car allowance, but I'm kind of expected to drive a nice car. I put 35,000 miles a year on this car. I don't get employer paid health benefits and I only get paid when the transaction comes to a successful closing, which can take months!
Now...who wants to be a Realtor??
In all seriousness, I could not imagine doing anything else. The satisfaction I have gained from helping hundreds of families buy and sell what is most often their biggest investment and where they raise their families, is something I can't even describe.
There have been many 'disruptors' in this industry over the years. What set's people like me apart, is that I will continue to put my head down, weather the storm, and do what's right no matter what.
