The IRS just released new guidelines for employers with employees 50+ or equivalents (reference Revenue Procedure 2024-35) in effort to determine affordability.
For benefit plan years starting in 2025, plans will be subject to the ACA's "Play or Pay" rules. The employee's contribution for the employee-only rate, cannot exceed 9.02% of their household income for the year. This was previously set at 8.39%.
If you're not sure if your company is compliant, feel free to reach out to us and we can help you determine which employees would be impacted by this new mandate, so you can avoid potential penalties!

On August 8, 2024, the Department of Health and Human Services (HHS) updated civil monetary penalties for inflation under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015. This adjustment affects various penalties, detailed in the updated table.

1. HIPAA Compliance: Ensure adherence to HIPAAโs Privacy and Security Rules to avoid penalties.
2. Avoid Incentives: Do not use incentives to deter Medicare/Medicaid eligible employees from joining your health plan.
3. SBC Disclosure: Make sure to provide Summary of Benefits and Coverage (SBC) to employees promptly, especially during open enrollment.

* Lower Out-of-Pocket Threshold: Now $2,000.
* Coverage Gap Changes: Transition from Coverage Gap Discount Program to Manufacturer Discount Program.
๐จ Why It Matters: Some employer-sponsored plans, especially high-deductible health plans (HDHPs), might not be considered "creditable" starting in 2025. This means they may not be as good as Medicare Part D.

2. Notify Participants: Inform Medicare Part D-eligible individuals about their coverage status.

The IRS recently announced in May 2024 changes for contributions limits for 2025 for HSAโs (health savings accounts), FSAโs (flexible spending accounts), and HRAโs (health reimbursement accounts).

โIndividual Coverage: The contribution limit is $4,300, up from $4,150 in 2024.
โFamily Coverage: The contribution limit is $8,850, up from $8,300 in 2024.
โCatch-Up Contributions: (age 55 or older): The limit remains $1,000.
๐Flexible Savings Account:
โHealthcare FSA: The contribution limit is $3,200, up from $3,050 in 2024.
โDependent Care FSA: The contribution limit remains at $5,000 (or $2,500 if married and filing separately).
๐Health Reimbursement Account:
โExpected Benefit HRA (EBHRA): The maximum contribution remains $5,000 (or $2,500 if married and filing separately).
