You may have received a recent – and surprising – notice from the County Assessor regarding the tax value of your home.

The County Assessor’s Office is responsible for fixing the taxable value of all real estate. The taxable value is the starting point for calculating real estate taxes. It should reflect the current fair market value of the property.

The Assessor must mail assessments to property owners by April 1st of each year if there is a change in value. Homeowners then have a chance to protest their tax assessment. If you believe the new tax assessment is incorrect, you can request a review.

Claim forms may be submitted from April 2nd to April 25th. A homeowner can also request an oral hearing to present a verbal argument to the Board of Review.

The homeowner must set forth the reason or reasons for protesting the assessment. Remember that you are not protesting your real estate taxes; arguments such as “the tax is too high” or “I can’t afford the taxes” are not valid reasons for appealing an assessment. Instead, you must focus on a reason why the assessed value is not correct:

1. The assessment is not equitable compared with the assessments of other similar property. This is the ground to use if you think your assessment is out of line with those of your neighbors.

2. Your property is assessed for more than its actual value. Remember that property generally appreciates in value. What you purchased the property for is generally not reflective of its current market value, unless you bought the home very recently.

3. There is an error in the assessment. Check your assessment carefully to see if there has been a mistake in describing your property. Be aware, however, that minor corrections may not affect your value.

Action of the Board of Review may be appealed to the Property Assessment Appeal Board and even to District Court.

You do not need legal representation to file an appeal petition or to appear before the Board of Review. But an experienced real estate attorney can help present your request for review in a focused and compelling manner.
