Ms. Pelier is a Cuban American who was born and raised in South Florida. She is fluent in both English and Spanish. Ms. Pelier graduated Magna Cum Laude from Florida International University in 2017 with a Bachelor of Science in Criminal Justice, as well as obtaining an academic certificate in Pre-Law Skills and Professional Values. Ms. Pelier then obtained her Juris Doctorate (JD) degree from St. Thomas University School of Law in 2021, where she was a competing member of her school's Trial Team, as well as a member of the Journal of Complex Litigation. Ms. Pelier began her legal career working at a first-party property and personal injury litigation firm and has experience in workers' compensation, first-party property, and personal injury matters.

Ms. Pelier now focuses primarily on family law and criminal defense matters but lends her expertise to many other legal issues you or your family may have. As Agosto Law’s new associate attorney, Ms. Pelier will be working directly with you, and the rest of our team, on your case.

INJUNCTION GRANTED!

A few weeks ago, a young woman filed an Injunction for Protection Against Domestic Violence against her husband after a long history of him abusing her and their 6-year-old son. It was a scary and uncertain time for our client. But then she chose to retain Agosto Law.

Last week, Attorney Agosto was able to secure an Injunction against the husband, prohibiting him from having any contact with our client and their young boy for the next 2 years! Our client was granted exclusive use of the marital home and the husband was required to vacate the residence that day.

Our office will be handling this young woman's divorce next, and we anticipate achieving similar results for her.

ANOTHER VICTORY FOR Agosto Law!

On April 6, 2023, our office was retained to represent a young woman who was arrested for failing to appear at her felony court date for Driving with a Revoked License as a Habitual Traffic Offender. The Judge had revoked her bond which prevented her from being released until her next court date.

Upon reviewing the case, our office found that the arresting officer listed an incorrect mailing address for our client, which meant our client never received notice of the hearing. We immediately filed a Motion to Reinstate our client's bond and requested her immediate release. The Judge granted our Motion and she was released from custody that afternoon.

Since then, our office was able to resolve our client's case by having her felony charge (punishable by 5 years in prison) reduced to a simple misdemeanor with no additional jail time. Our client walked out of the courtroom a free woman.

Vanessa is the firm’s Paralegal and Notary Public with 5 years in the legal field, whose primary focus is Family Law matters, including child custody and divorce cases. Raised in a Caribbean household in Dade County, Florida, she has a diverse background and brings that experience to the firm to work with clients from different cultures and ethnicities.

She has relocated to Orlando and attends the University of Central Florida. She is set to graduate in Summer 2023 with a Major in Interdisciplinary Studies and a Minor in Public Affairs.

With a natural love for the legal field, she is passionate about providing excellent service, patience, and deep understanding to our clients during some of their most difficult times. Outside of the office, she enjoys amusement parks, the outdoors, and everything Florida has to offer.

ABOUT THE IMPORTANCE OF HAVING A VALID WILL.

The key reason one should have a will is that without one, a person dies “intestate.” That means the State of Florida will decide who inherits and manages the assets, not the decedent (the person who has died). This is the case in Florida and several other states.

Without a Will, assets will be distributed according to the Florida's Intestate Succession Law, and whether a person can be an heir depends on his or her relationship to the deceased. That is not likely to be the best plan for the family. Not everyone wishes for a surviving spouse, children, and possibly other relatives to inherit the portion of their estate as dictated by the intestate law. In order to avoid Florida's intestacy statute, a legally valid Will must be executed in accordance with Florida law.

Comprehensive estate planning can seem daunting and confusing. But, with proper counsel from an experienced attorney, the process can ultimately save you and your family hundreds of thousands of dollars and give you peace of mind knowing that your estate is protected and directed as you desire, and your wishes during your lifetime and afterward are legally documented and binding.

With Labor Day Weekend upon us, many of us will be traveling to spend time with friends and family. But did you know that Labor Day Weekend is one of the highest DUI arrest weekends of the year? As a result, police are more vigilant and keep a sharp eye on the road for any evidence of drunk drivers.

It's important not to drink and drive. But, if you do get pulled over, here are a few tips to keep in mind:

1. Drive slow and steady. Find a safe place to park your vehicle and wait for the officer to approach the driver side.
2. Remain calm. Sweating, fidgeting, and slurring words are major DUI indicators.
3. Only speak when spoken to. Do not offer any information other what is requested. Try answering with simple a simple yes and no as much as possible. Excessive talking only serves to incriminate you.
4. Remember you always have the right to refuse to perform field sobriety exercises.
5. Remember you always have the right to refuse to perform a breath or urine test. However, under Florida's Implied Consent Law, your license may be suspended for refusing to do so.
6. Finally, keep your attorney's contact information saved at all times. If you are being placed under arrest, you won't be able to search for lawyers in your area. You will want their business card or phone number at the ready so they can assist you as soon as possible.
