IMPORTANT NOTICE | SARS ADMINISTRATIVE PENALTIES FOR LATE SUBMISSION OF TAX RETURNS

With effect from 1 December 2022*, administrative penalties relating to the late submission of a tax return will be charged when one or more tax return(s) relating to tax years from 2007 up to 2020 are outstanding. Prior to this change, taxpayers were only liable for administrative penalties for late submission if they had two or more returns outstanding for these tax years.

TOP TIP: Regardless of whether you agree or disagree with the admin penalty it is advisable to submit your outstanding returns to stop further admin penalties.

Penalties will reoccur for every month the return(s) remains outstanding for a maximum of 35 months.

Administrative non-compliance penalty can range from R250 up to R16,000 a month for EACH month that the non-compliance continues and is based on a taxpayer’s taxable income.

What if I don’t agree with the Penalty?
The Taxpayer can submit a Request for Remission (RFR) to dispute any penalty levied due to non-compliance and must provide reasons for the non-compliance and for the request to be considered.

TRUE OR FALSE | WHEN I ONLY RECEIVE AN IRP5 FROM MY EMPLOYER, I DON’T NEED TO SUBMIT AN INCOME TAX RETURN?

If I ONLY receive an IRP5 from my Employer and NO other income such as exempt local dividends and interest do I still need to file a Personal Income Tax Return with SARS?

This is not a quick yes or no answer. You need to look further…

- Did you receive an allowance such as travel, subsistence or office bearer allowance on your IRP5? Yes – you need to submit a return
- Did you receive an Income Tax Return or where you asked to submit an Income Tax Return for the tax year? Yes – you need to submit a return
- Are you claiming tax related deductions/rebates (e.g. medical expenses, retirement annuity contributions other than pension contributions made by your employer, travel)? Yes – you need to submit a return

REMINDER>>> To ALL Non-Provisional Individual Taxpayers and Trust to submit their Individual Income Tax Return (ITR12) by Monday, 24th of October 2022 for the 2022 Year of Assessment (February 2022).

If an employer submits the EMP501 late, administration penalties will be charged. The penalty will equal 1% of the year’s PAYE liability, which will increase each month by 1% point up to 10% of the year’s PAYE liability.

Furthermore, an Employer who wilfully or negligently fails to submit and EMP201 or EMP501 return to SARS is guilty of an offence and is liable, upon conviction, to a fine or imprisonment for a period of up to 2 years.

From October 2022 SARS will initiate Auto Registration for Individuals that is NOT registered for tax, based on 3rd party data that indicates economic activity of the Individual.

DEPARTMENT OF LABOUR: RETURN OF EARNINGS (WA.s2) 2022

ROE ONLINE SYSTEM TEMPORARY SHUTDOWN ALERT

The Department issued a Notice to all Employers that the Compensation Fund will have a temporary shut-down of the ROE Online System from 18 March 2022 (16h00) until midnight 31 March 2022.

Service that will be impacted during the ROE Online system shut down period:

Employer registrations (including CIPC BizPortal platform as well as through the CF’s back-office processes);

Employers will not be able to declare any Returns, either online or manually during this time;

The auditing of employers who are flagged for audit

No instalment applications will be considered during this period

When submission opens on 1 April 2022 please note the Maximum Earnings on the Actual earnings is R506,473 ( 1 March 2022 to February 2022) and for the Provisional Assessment R529,264 (1 March 2022 to 28 February 2023)

The submissions of the actual earnings for 2021 and payment of your invoice is due by 31 March 2022 to qualify in receiving your letter of Good Standing on time. If there is a variance of more than 20% between the 2021 actual and 2022 estimated earnings you will be required to provide the RMA with a copy of your audited payroll report or EMP501/201 for 2021 to support the variance. Delict – Duty of Care
β€œSkade rus waar dit val”

Agreements were concluded by a plaintiff with a developer for the sale of abutting immovable properties, with a plan to build a sectional title development. The transaction was unusual, entailing a substantial risk in that it involved the plaintiff’s homes being demolished to allow for the new development. The agreements were prepared by the attorneys. The property market crashed, units were not sold and the development imploded. It was never completed except for foundations and a unit that achieved roof height, and the plaintiffs lost their homes. The plaintiffs’ claim in delict alleges that the attorneys owed them a duty of care and acted negligently and in breach of the duty.

The court concluded that the principle in delict that everyone has to bear the loss he or she suffers (skade rus waar dit val) must apply in these circumstances.
