ARTICLE 20 (INSTALMENT SALES)

• The buyer is sometimes black-listed, and cannot obtain a bond from a bank, but they do have the funds to buy a property on section 20 Endorsement option. The buyer must be able to afford the property. (affordability of the essence)

• The buyer carries all the risk.

• The Seller has NO risk in this sale. (only on cancelation of the article 20 and sometimes a month or two arrears in municipal or levy amounts)

• Should the buyer default, they will be put on terms and if they can rectify it will be good, if not, they will lose all the funds they paid. The seller does not have to pay back. The seller must keep in mind that the term is 60 months for the buyer to pay the property, therefore it can ask for leniency in this period.

• The buyer must pay a deposit (can be once off or over 2 or 3 months) but most buyer pay deposit immediately.

• The deposit is used to pay the FULL commission to The Property Agent, and what is left of the deposit stay with the attorney in an interest-bearing account, until the article 20 has been registered and only then they will start to pay directly to the seller. Each month the buyer must send us all the proof of payments for us to be able to keep a statement of account. If they do not adhere to sending proof of payment, they will have to do the statement of account themselves. The law states that the buyer and seller must have a statement of account once a year.

• The buyer needs to pay the amount of an amount as will be quoted by the the attorney to register the article 20 within the first 2 months, but we always ask for it in the first month. The quicker we receive this amount and the title deed either from the bank or the seller, the quicker we can register the article 20.

• The registration of the article 20 means the following:

1. The seller can not once registration is done, sell to any other buyer.
2. The seller can not take a bond on the property.
3. The seller stay the full owner of the property until the last and final payment and when transfer fees are paid by the buyer to register the property in the buyers name.
4. The buyer name only gets endorsed on the title deed under the sellers name.
5. The seller can not loose his property, and the buyer is secure that he will not loose all his money invested in the property.

• This registration of article 20 is to see that the seller is safe as well as the buyer. Seller not allowed to sell to anyone else neither bond the property, and the buyer can only loose funds if he defaults now.

• The registration of the article 20 means that the title deed of the seller is send to the deeds office and the attorney endorse the title deed with the buyer’s name.

• Doing the COC (electrical certificate of compliance) as quick as possible will be better, due to increase in prices in 5 years.

• The buyer pays no interest because the seller is not a registered financial institution.

• The buyer must keep the property in same condition or improve the property. Should the buyer default he won’t be able claim improvements. If the buyer does not keep the property in a fair and good condition as found, the buyer will be in breach of contract. The buyer can be put on terms and if the buyer do not rectify, the transaction will be cancelled and the buyer will need to vacate the premises.

• The buyer is liable to pay all municipal and if levy accounts from the date of occupation, (municipality will be only the end of the first month)

• The buyers can pay faster (2 or 3 months ahead or lumpsums) but not slower – only have maximum 60 months.

• The buyer can either live there themselves or they can put a tenant in to help them pay faster or just to help with monthly payments.

• The buyers can accelerate the payments but not pay slower – law states the payment terms for an Article 20 is not less than a year and not more than 5 years.

• There is a clause for leniency which is a favor and not a rule, should they have a problem one month. The buyer will be made aware that he can not ask for a default on a default arrangement.

• After 60 months the property will be fully paid, and the buyer will then need to take full transfer of the property onto their name/s . The title deed with the endorsement must go back to the deeds office and then be replaced by the new title deed.

• MOST important is that the buyer know that the buyer, should they default, they will loose all funds paid to the seller for it works just like with a bank. The bank do not refund the buyer when he defaults, the bank will still hold them liable for the outstanding amount even after they have sold the property to a 3rd party.

• The seller undertake that should the buyer default and vacate the premises within 30 days, he will not keep the buyer liable for the last default month, but should the outstanding be higher, the seller will use his own decision if he wants to recover the loss of the amount while the buyer still stayed in the unit. This will be at the cost of the seller. Thus all said, we undertake to do our best to prevent to not let the buyer get in default for more than 30 days, which in honesty is sometimes not possible.
