Who cannot claim from the RAF?

You CANNOT claim from the RAF if:

1) you were the driver and you are the owner of the vehicle solely responsible for the accident;

2) you were the only person involved in the accident (e.g you were seriously injured as a result of crashing your car into a wall or other structure and nothing else contributed to the accident).

Road Accident Fund claim time limits:

The Road Accident Fund(RAF) requires you to lodge your claim within 3(three) years of the motor vehicle accident if you know who was responsible for the accident.

If the responsible driver is unknown, for example in the event of a hit-and-run accident, the RAF requires that you lodge your claim within 2(two) years from the date of the accident.

Who can claim from the Road Accident Fund?

Drivers, passengers, pedestrians, cyclists and motorcyclists can all claim from the Road Accident Fund as long as they weren't entirely responsible for the accident.

You can claim from the RAF if:
- you were injured in an accident and you weren't the driver solely responsible for the accident.
- You are the driver responsible for the accident but not the owner of the vehicle and the accident was as a result of the owner's negligence (i.e the owner failed to replace worn brake pads on the vehicle).
-You are a child, spouse or other person dependant on the income of a person killed in an accident.
