DIVORCE!

The Pretoria High Court on Wednesday 11 May 2022 ruled that a part of South Africa’s Divorce Act is unconstitutional, setting up major changes for how divorces are handled when couples are married out community of property in the country.

The court judgement declared that Section 7(3)(a) of the Divorce Act is inconsistent with the Constitution and invalid, saying it amounts to unfair discrimination in respect of ‘out of community of property’ marriages.

Section 7(3) of the Divorce Act deals with the division of assets for couples married out of community of property. However, Section 7(3)(a) lays out different rules for marriages that took place after the Matrimonial Property Act came into effect on 1 November 1984.

This difference, the court said, amounts to unfair discrimination – particularly for economically disadvantaged people – and limits the operation of Section 7(3).

The Constitutional Court will now have to consider whether the order should be confirmed or not. Should the order be confirmed, it will have a significant and compelling effect on many marriages in South Africa.

Labour Law Update!

On Friday 18 March 2022 a government guide on dealing with sexual harassment at work was replaced by a guide also covering bullying, and racial harassment.

It defines various types of harassment including passive aggressive harassment via facial expressions

Employers, including those of domestic workers are now required to protect their employees from condescending eye contact by visitors and staff.

HOT OFF THE PRESS FROM OUR IMMIGRATION DESK!!

The Minister in the Presidency, Mondli Gungubele today (25/11/2021) outlined the outcome of a cabinet meeting held yesterday (24/11/2021).

With regards the current Zimbabwean Exemption Permit (ZEP), cabinet has approved and communicated that:

1. The ZEP expiring on 31st December 2021 will not be extended
2. ZEP holders are given a grace period of 12 months to apply for permits they qualify for in order to legalise their stay in South Africa (appropriate to their particular status or situation).
3. At the expiry of this 12 month period, those who are unsuccessful will have to leave South Africa or be deported.
