The Institute for International and Comparative Law in Africa (ICLA) invites members of the Faculty and broader University Community to a seminar entitled: The role of constitutional courts in post-coup d’état and post-insurrection transitions: The West African cases of Niger, Burkina Faso, and Mali.

In recent years, a resurgence of military coups has been observed in West Africa, particularly in countries such as Niger (in 2010) Mali (in 2012 and 2020) Guinea Conakry (in 2008 and 2021) and Burkina Faso (a popular insurrection in 2014 and military coup in 2022). All these coups d'état led to the suspension of the normal constitutional order and the setting up of transitions to organize a return to normal constitutional order. The constitutional judge has often been a key actor in these transitions.

This presentation focuses on the role of the constitutional judge in these post-coup transitions. Through the study of five transition situations in three countries (the transition in Niger, the two transitions in Mali and the two transitions in Burkina Faso), I will discuss the role that the constitutional judge has played in the setting up of the transition, the conduct of the transition and the restoration of the normal constitutional order. I will also give some assessments of the work of the constitutional judge during these transitions and its possible impact on constitutional stability.

UP Law extends hearty congratulations and a warm welcome to Emeritus Justice Sisi Khampepe as the newly appointed Chancellor of the University of Pretoria.

Emeritus Justice Sisi Khampepe, who recently retired as a Judge of the Constitutional Court of South Africa, has been appointed the new Chancellor of the University of Pretoria (UP) with effect from 28 June 2022.

Justice Khampepe will take over the role of Chancellor from Professor Wiseman Nkuhlu, who was inaugurated as the Chancellor of UP in March 2007 and served from 2007 to 2022. UP Vice-Chancellor and Principal Professor Tawana Kupe said, “We are grateful for Professor Nkuhlu’s outstanding contribution and commitment to the University over the past 15 years. His term as Chancellor will expire on 27 June 2022.”

UP Law successfully hosts second specialised short programme on 'Promotion and Protection of Investment in Africa'

During May 2022, the University of Pretoria’s (UP) Department of Public Law commenced with the delivery of the first module of a specialised short programme on ‘Promotion and Protection of Investment in Africa’ under the auspices of the Extractive Industry Law in Africa Unit (EILA). The online programme, delivered in collaboration with Cliffe Dekker Hofmeyr and hosted by Enterprises University of Pretoria, offers a novel and unique introduction to the law and policy fundamentals of investment protection on the Africa continent. This course follows on the first successful inaugural course which took place from 12 to 20 October 2020.

A UP Moot Society team obtains silver and gold in 2022 Manfred Lachs Space Law Moot Court Competition

A team of the University of Pretoria’s (UP) Moot Society participated in the African Regional Rounds of the 2022 Manfred Lachs Space Law Moot Court Competition on 12 and 13 May.
The trio, consisting of oralists Comfort Ayelomi (LLB III), Koketso Moshira (LLB IV) and researcher Molebogeng Ramaijane (BCom LLB III), coached by Kgomela Letsoalo, was declared second runners-up in the first regional round held since the COVID-19 pandemic began in 2020. The team also walked away with the best memorials prize.
