TOPIC: RETURNING RESIDENTS

1. Who is a returning resident?

A. A returning resident is a term used to refer to a Zambian traveler who arrives at the border after having been out of Zambia for less than four years. Such a visit could have been a business trip, attendance of a study program or a mere visit.
B. Regulation 86 of the Customs and Excise (General) Regulations, 2000 provides for the clearance of travelers effects, and returning residents are included in this category.
• A returning resident is entitled to goods worth US$1,000 to be imported duty free and any excess as long as the taxes are below K10.
• In both cases the goods should not be for commercial purposes or belong to any person who is not a traveler. This means that NO person can send anyone to go and purchase some goods for them and enjoy the duty-free allowances.
• The rebates do not apply to the gifts that the traveler could buy for either the family or the friends.
• The goods stated above do not include the excisable products. The following excisable products can be imported duty-free in the quantities specified as long as the returning resident is above the age of 18:

2. Oh that that sounds good. However, the law seems to be excluding citizens who have lived outside Zambia for at least four years; do they enjoy any rebate?

 Regulation 85 of the Customs and Excise (General) Regulations, 2000 provides for the clearance of goods for New Residents.
 Unlike a returning resident, a new resident is:
 A Zambian who arrives in the country to take up residence after having lived outside Zambia for at least four years; or
 A foreigner who arrives in Zambia to take up residence
 In both cases, the new resident is entitled to a remission of duty in respect of household and personal effects including one motor vehicle per household or family

3. What does one need to do in order to enjoy the new resident’s rebate?

• The new resident will need to prove to the satisfaction of the Zambia Revenue Authority (Commissioner General) as follows:
a) In case of a Zambian, the new resident has been resident outside Zambia for a period of not less than four years before the date of arrival in, or return to, Zambia;
b) In case of a non-Zambian, they need to prove to the satisfaction of the Commissioner General that they have to come to take up residence in Zambia.
c) That the effects were the property of the new resident before the date of departure for Zambia from the previous country of residence; and
d) (c) that the effects were imported by the new resident at the time of arrival in Zambia, or, if there is any delay between the arrival and the importation of the goods, that the delay is not more than six (6) months;

4. What if they arrive in Zambia 4 days before they reach the four years period?

Unfortunately they do not qualify and just to add on, for motor vehicles, they are issued with a red book and not a white book. This means the vehicle cannot change ownership for a period of 5 yrs.
