Running SA LK
In Part 1 and Part 2 of LK's Defence series, Claire Clutterham examined the recommendations made in the 2023 Defence Strategic Review (DSR). Some of the most prominent recommendations related to Australia’s strategic interests in the Indo-Pacific region, which had an emphasis on building and strengthening partnerships that could benefit the protection of Australia’s national interests.
In Part 3, Claire explores Export Controls: AUKUS was singled out as a partnership of significance. In parallel with that partnership, the DSR also emphasised the need to invest in technology and innovation, and to simplify the transfer of technology between partners. When it comes to AUKUS, the efficient and effective transfer of technology is critical to the success of the endeavour. In Part 3, LK analyses the Defence Trade Controls Amendment Act 2024 (Cth) (‘DTCA Act’) and considers what is meant by the “licence-free” environment.

Part 1, released on 15 August 2023 examined the initial recommendations from the DSR, including a renewed focus on the Indo-Pacific Region, the need for a national approach, the concept of enhancing the capacity for deterrence and the effects of climate change and disaster support relief on defence resourcing.

For more than 10 years, LK has supported The Magdalene Centre, a partnership in mission between St Mary Magdalene’s St John’s in Halifax Street, St Peter’s Cathedral Adelaide and Anglicare SA. One of the many vital services they provide for patrons is a three-course meal on Saturday evenings. Last Saturday, a group of LK volunteers took on the task of providing the dinner service, including cooking and serving three different soups, roast pork, a variety of pasta and potato bakes and some delicious desserts.
The evening ran very smoothly with the team serving up a hearty meal, that was greatly appreciated on a rather chilly Adelaide evening, with plenty of patrons also leaving with leftovers.

"I was first introduced to LK in November 2020 through A Day at LK, a program designed to offer law students in their first three years of study, the opportunity to spend a day at LK and learn about the firm and its work. I was so impressed by the firm, its cross-jurisdictional practice and its great culture that this experience led me to apply for the clerkship program in my penultimate year.
During my clerkship, I had a good mix of both legal research and factual work and was exposed to some of the international investigative work the firm undertakes. The training you receive at LK during your clerkship is truly invaluable, especially in effective research methodology and legal writing.
After completing my clerkship I was thrilled to receive an offer to return as an ongoing clerk and work part-time as I completed my studies.
Apart from its commercial practice, LK also has a strong commitment to pro bono work. As a part of LK’s numerous community initiatives, the firm provides pro bono support to JusticeNet SA through the Refugee and Asylum Seeker Program (RASP). As a clerk, I worked on several RASP matters and found the experience to be rewarding and a great way to give back to the community.
I am proud to be a part of LK two and a half years on. LK's Claire Clutterham is looking forward to presenting on "Technology Transfer - International Regulatory and Commercial Law Issues" as a part of the upcoming University of Adelaide Professional Certificate in Nuclear Law being offered from 1 to 5 July 2024.
This exciting new program will provide participants with an in-depth analysis of the theoretical and practical aspects of nuclear law and policy, especially in the context of Australia's strategic defence initiatives and will have immediate application for professionals engaged in the nuclear law sphere.

This month, LK Principals, Brooke Hall-Carney and Amy Cooper-Boast joined with Charlie Cropper and Morgan Stanley to present “Cyber Risks: Mitigation and Response” to audiences in Sydney and Adelaide.
Cyber incidents can have potentially devastating financial, legal and reputational consequences for organisations that are not in a position to adequately prevent or respond to them. The legal ramifications for companies and NFPs, including their directors, are increasing, while the scale and sophistication of cyber attacks grow exponentially.

"We’re Going to Need to See Some ID: ASIC Brings the First Prosecution under the Director ID Regime" - All company directors in Australia are required to verify their identity by way of the director ID regime.
A failure by a director to comply with the obligations under the regime exposes that director to the very real risk of potential civil or criminal penalties. For one director, that risk has become reality with ASIC having recently brought the first prosecution case against a director for failing to comply with the director ID regime.

LK is now accepting applications for our 2024/25 Clerkship Program and we encourage students from 3rd year on to apply.
Clerkships at LK offer law students the opportunity to join our team for four weeks across one of three intakes. As a clerk you will experience a diverse range of tasks to develop your knowledge and legal skills. You will have direct contact with principals and senior members of LK as well as your peers, with teamwork being an absolute priority. To guide you in your experience you will be supported by a mentor and buddy and receive training on our office procedures and resources and participate in legal education and firm wide training sessions.
Our Clerkship Program is an important career pathway, with many of our clerks joining the firm as graduate lawyers once admitted.
