A parenting plan is a signed written agreement between the parents that sets out the care arrangements for the child/ren such as time spent arrangements, communication, changeovers, special occasions, significant dates, medicals etc.
A parenting plan approved by the Federal Circuit and Family Court of Australia is a 'consent order' (an agreement reached between the parents). Once the Court has made a consent order, it is binding on both parents.

Final Parenting Orders: The Rule in Rice v Asplund βοΈ
Final Parenting Orders are family law orders that detail the parenting arrangements for a child, which are made on a final basis and intended to remain in force until the child turns 18.
A party who wishes to vary existing final parenting orders must bring an initiating application before the court setting out the variation sought.
The court will only consider varying final orders if it is satisfied that the test outlined in the 1979 decision of Rice v Asplund has been met.
In deciding whether there has been a significant change of circumstances, the court will consider the changes in circumstances together with the facts of the matter. Whilst there are no specific circumstantial changes that automatically satisfy the rule in Rice v Asplund, there are a number of situations where parties may have a higher chance of success in satisfying the rule.

When is a family law property valuation required?
If there is a dispute over the property value, then it is likely that an independent value will be required to reach a successful property settlement.
A single expert witness (a certified practicing valuer, registered by the Australian Property Institute) is appointed and instructed jointly by both parties (usually with the parties to share equally the costs).
The value provided by the single expert is accepted by the Court as evidence.

In Australia, it is broadly accepted that parents should try to resolve their dispute using an accredited family mediation service before starting an application with the Federal Circuit and Family Court of Australia.
A section 60I certificate to start family court proceedings in Australia is required unless any of the following applies:
a) an agreement has been reached and you want to file consent orders;
b) you are responding to another partyβs application;
c) if your matter is urgent;
d) there are family violence or child abuse concerns;
e) if you want to make a family court application in relation to another partyβs non-compliance with a court order made in the last 12 months and the other party has behaved in a way that shows a serious disregard for their obligations under the court order;
e) one party is not able to participate effectively in FDR (for example, incapacity or for some other reason); or
f) other circumstances specified in the regulations are satisfied.
See section 60I(9) Family Law Act 1975.
A section 60I Certificate can only be used for 12 months from the date it was issued.

The Court appointed an Independent Children's Lawyer (ICL). What is an ICL?
An ICL is an experienced solicitor appointed by the Court to represent a child. The ICL is obligated to consider the views of the child and to provide their own independent perspective about what arrangements or decisions are in the child's best interest.
Their main roles include:
β
arrange necessary evidence, including expert evidence, to be obtained and put before the Court;
β
facilitate the participation of the child in the proceedings in a manner which reflects the age and maturity of the child and the nature of the case; and
β
act as an honest broker between the child and the parents and facilitating settlement negotiations where appropriate.
