Another question I often get asked is “what do you think of writing your own will or using a Do it Yourself (‘DIY’) Will Kit?”
My honest answer to this question is that you are better off spending a bit now on a will prepared by a lawyer than having your loved ones spend thousands of dollars after you die to prove to the court that the will is legally valid. As a lawyer, I have seen the court reject wills that have been prepared incorrectly and clients spend thousands of dollars from the estate and time in trying to convince the court that the will is legally valid. For a will to be valid it must be prepared correctly and signed in the presence of two witnesses. A simple error in the will such as signing the will with difference pens will draw the attention of the court and question the validity of the will.
A DIY Will Kit or online Will can be a suitable low-cost option provided the will is simple and it is executed correctly. DIY Will Kits, however, cannot adequately handle complex financial situations such as trusts and self-managed super funds. Further, a will DIY Will Kit may be too simple to capture all of the important factors in relation to the guardianship of your minor children and blended families situations.
As a lawyer, people often ask me “why do I need a will?” I often tell people that if you have significant assets like real estate property, you have children and/or have a blended family then you need a will. This is particularly the case if you do not wish for your loved ones to spend additional time, money and emotional energy to settle your affairs after you die. If you die without a will, the laws of intestacy apply and your estate can only be distributed to your closest relative(s). This means you will not be able to give gifts to persons who are not related to you or donations to charities that can help to offset the tax payable by your estate. Importantly, with a will you can prevent estranged relatives from receiving your assets and identify who should care for your minor children. Without a will, the courts will decide.
