FAQ: I’m an owner-builder and now want to sell, what are my responsibilities?
Owner-builders selling their home within 6 years and 6 months of completing the building work must disclose these items in their Section 32 Statement:
✅Section 135: domestic building insurance certificate (only applicable for work $16K or more)
✅Section 137B: building report
✅Section 137C: building warranties
✅Defects inspection report
This applies to new homes, along with garages, sheds, verandahs and house extensions.

What is title insurance and do I need it?
As a buyer, title insurance protects you against things which are unknown to you when you settle – and which become your responsibility as the new land owners.
Title insurance can cover you for things such as unapproved and / or non-compliant building work, boundary encroachments and complete loss of legal ownership due to a fraudulent sale or mortgage of your property.
Without title insurance, you’re not protected from these things which means your ownership of the property could be affected - and cost you money

Can I change the settlement date?
If both the buyer and seller agree, yes the settlement date can change. Common reasons settlement dates change:
🏠Buyer wants to move in earlier
🏠Tenant vacates the property
🏠Simultaneous settlement where sale has to occur on same day as purchase.
The request to change settlement date must be made in writing by a conveyancer a minimum 2 weeks prior to the original settlement date. – depending on the SC in the Contract of Sale as there may also be associated costs to change a date too.

FAQ: How do I recover my Certificate of Title?
If you’re selling property, you must provide the Certificate of Title as it’s a legal document and the official record of land ownership.
If you’ve lost your Certificate of Title, it can be recovered via an Application via Land Use Victoria. It usually takes a few weeks to recover the title.
Only conveyancers or lawyers can submit the Application.

FAQ: What is settlement?
Settlement is the legal process to transfer property ownership from one party to another. The seller sets the settlement date – usually 30, 60 or 90 days - and is included in the contract of sale, and is signed by both seller and buyer.
On settlement day, the buyer provides the funds in full to purchase the property to the conveyancer. Once the funds are received, the Certificate of Title is provided to the buyer’s bank.
Only then can the buyer receive the keys to their property.

When a property is sold, the purchaser pays an initial deposit. That deposit goes into the real estate agent’s trust account – and nobody has access to the funds until the property settlement date.
A Section 27 is a written request from the vendor to the purchaser, requesting early access to the deposit before settlement. A bank letter is also required to confirm the request.
The purchaser has 28 days from when they receive the Section 27 to either accept or reject. If it’s accepted, the money is immediately released.

During the cooling off period, you can arrange finance, have the Section 32 and Contract of Sale reviewed by a conveyancer, conduct a building inspection, reconsider your offer, talk to family and friends about the property and more.
If you decide you no longer wish to purchase the property, you need to put it in writing to the seller or the seller’s agent.
