Financial Planner Canna Campbell (SugarMamma) Guilty of IP Infringement

Key Takeaways:
1. After ignoring a cease & desist letter, Campbell was informed of an “adverse finding” (Dec 2020 & Jan 2021) after unsuccessfully attempting to register "SugarMamma’s Financial Foreplay”. IP Australia stated the application did not meet the requirements for acceptance - it was substantially identical (or deceptively similar) to a trademark registered by Ms Korolak.
2. Notwithstanding the rejection, Campbell continued to use “Financial Foreplay” in support of several commercial initiatives, & made written representations to Podbean, Facebook, & Apple iTunes she had the legal right to use it & Korolak's complaints were baseless. The court held - “it is difficult to identify any rational basis on which Mr Taylor could have represented to Podbean that “Ms Korolak’s allegations have no basis in law”.
3. The court held that correspondence to these platforms failed to:
· disclose Campbell had received two adverse assessments, &
· divulge Campbell’s rejected application included classes 36 and 41 - meaning, she knew (or reasonably should have known), she was providing financial advice or education.
4. In debunking Campbell’s testimony and submissions that she did not provide “financial advice” or “education”, the court held that:
· Campbell herself described the podcast as “financial advice” & “education” online
· Campbell's unsuccessful trademark attempt included “financial advice” & “education”
· After reviewing the entirety of several episodes, the judge determined that Campbell recommended financial products and services, & gave “financial advice”
5. The court rejected Ms Campbell’s testimony & submissions that her content was not “financial advice”, saying he did not give her statements on the issue “any weight.”
6. Campbell refused to acknowledge the authenticity of the registered trademark Financial Foreplay, declined Korolak’s request for an undertaking to remove the infringing content, & proceeded to threaten Ms Korolak with:
· defamation
· unlawful interference with contractual relations
· “severe & quantifiable financial losses”
· an injunction to prevent Ms Korolak from applying to have the content removed &
· an application to have Ms Korolak’s valid trademark struck from the register
7. The court held – “it is difficult to identify any justification for the claims Mr Taylor made that Ms Korolak acted improperly in communicating her belief to Podbean that Ms Campbell’s use of “SugarMamma’s Financial Foreplay” in the FF Podcasts constituted an infringement of the Trade Mark.”
8. Despite the IP Australia rejection, Ms Campbell signed a legal declaration that she did not believe the content should have been removed by Facebook.

Someone else on Twitter looked into the story and indeed, the town that Andros Company, the makers of Bonne Maman, comes from, hid and saved Jewish families in WW2. It was called Biars sur Cere, which then had about 800 villagers.
From an article, “You have to understand what it was like then. There were posters on the walls, from the N***s and from the collaborators, and they said that if you are found to help a Jew, a freemason, a communist, a socialist, or a pervert, you will be shot on sight.” Despite the great danger in which helping them put the villagers in, still they kept the children safe.”
A good reason to buy Bonne Maman products. And a poignant reminder that when we look out for each other it can change lives, and that there are good and selfless people in the world.

What do you make if this latest trend advising consumers to boycott the big brands making super profits whilst hardworking, everyday Australians are doing it tough due to skyrocketing inflation and interest rates?

Why are and others making super profits when it’s clear that individuals are being punished for overspending with repeated interest rate rises?

I saw this on instagram today. Whilst the math may be correct, the conclusion is off a bit…

According to data released just last month by the government, only 2% of the population has a combined income greater than $180,000. What this means is that whilst a mortgage on an $896k home might only be 38% of your combined income ($94k x2), only 2% of the population qualifies for it. The number of Australians who bring in this much combined income is actually very small. And we all know the median house price is now higher than this in both Sydney and Melbourne.

Today marks the start of the trial to defend my registered trademark Financial Foreplay and collect damages for alleged unauthorised use by Canna Campbell and Sass Financial Australia. We are in the Federal Circuit Court with judge Manousaridis presiding via Microsoft teams. I fell incredibly blessed to have presenting my case as he is an expert in trademark law and litigation of IP matters.
So relieved this matter will finally be adjudicated based on trademark law and the merits of my case.
