Judgment just in: Elwood v Director of Public Prosecutions [2023] NSWSC 772

The Supreme Court has upheld an appeal against the decision of a magistrate in the Local Court to commit Mr Elwood to trial for three indictable offences and two summary matters. The magistrate entered not guilty pleas on behalf of Mr Elwood. This decision was made despite active and ongoing negotiations between the prosecution and defence, and Mr Elwood’s indication that he wanted to continue to negotiate. The Court held that the magistrate erred by prejudging the matter without having heard from the parties why they were seeking an adjournment and failing to consider alternative pathways under s 76 of the Criminal Procedure Act. The magistrate’s decision deprived the offender of a significant right of a discount for a guilty plea. The Court set aside the decision of the magistrate and remitted the proceedings before a different magistrate.

The Court of Criminal Appeal has allowed an appeal against Ms Camilleri’s sentence for the manslaughter of her mother. She has been re-sentenced to imprisonment for 16 years and 6 months, with a non-parole period of 12 years.

Tougher penalties for serious data breaches 24/10/2022

A new Bill has been introduced to Parliament intending to legislate tougher penalties for repeated or serious breaches of privacy and protect personal data collected by companies.

The Privacy Legislation Amendment (Enforcement and Other Measures) Bill 2022 will increase maximum penalties that can be applied under the Privacy Act 1988 for serious or repeated privacy breaches from the current $2.22 million penalty to whichever is the greater of:

* $50 million;
* three times the value of any benefit obtained through the misuse of information; or
* 30 per cent of a company's adjusted turnover in the relevant period.

Tougher penalties for serious data breaches The Albanese Government will next week introduce legislation to significantly increase penalties for repeated or serious privacy breaches.

Now, more than ever, a collaborative approach to family law is necessary to achieve just results for clients. The COVID-19 Pandemic has caused a significant backlog in all Court lists and Judges are becoming overwhelmed with heavy workloads. You would be lucky to get a final hearing within 2-3 years after filing in the Federal Circuit and Family Court of Australia!

Whether it’s before or after Court proceedings have commenced, a lawyer can never underestimate the value of trying to resolve a dispute without the need to proceed to stressful hearings. This doesn’t just apply to family law, but certainly other areas of law including criminal law. No doubt there are some matters that just simply cannot resolve on a final basis, but it is always worth attempting narrowing issues in dispute. It’s time to move forward, be solution-drive and try to create peace for those caught in litigation.
