This new Innovation Stream Pilot will allow certain Canadian companies to bring in highly skilled foreign workers on work permits without needing an LMIA (Labour Market Impact Assessment).
Jobs in National Occupational Classification (NOC) categories 0, 1, 2, or 3 (Training, Education, Experience, and Responsibilities) are considered high-skilled jobs.
Furthermore, family members of these foreign workers will be eligible for an open work permit, allowing them to work for almost any employer in Canada.
The Innovation Stream is scheduled to continue for two years, ending on March 22, 2026, unless there are any changes.
On June 27, 2023, the Immigration Minister announced the Canada Tech Strategy and as part of it, the minister announced that a new innovation stream would be introduced to bring talented workers to help build innovative businesses.
Innovation Stream Pilot Eligibility Criteria
To apply for a work permit under the Innovation Stream Pilot, foreign nationals inside or outside Canada need a job offer from one of the eligible employers under the Global Hypergrowth Project.
Applicants need to fill out their work permit application using the IRCC Secure Account.
The job offer must fall under a TEER 0, 1, 2, or 3 occupation as per the National Occupational Classification.
Offered wages must be equal to or higher than the median hourly wages set for the region.
If the position is covered by a bargaining agreement the wage offered must also meet the standards outlined in that agreement.
Additionally the job offer should state that the employer will review wages on the first day of work and annually by January 1 to ensure they remain competitive throughout employment.
Immigration officers must be satisfied that applicants have the skills, for the job they are applying for.
They should consider whether applicants meet the education and experience requirements specified in the National Occupational Classification for their offered occupation.
NEW CANADA IMMIGRATION BACKLOG
Canada’s immigration backlog rises slightly, as per the new IRCC updated data, with a total of 2,220,200 citizenship, permanent residence, and temporary residence applications under processing as of April 30.
On May 27, Immigration, Refugees, and Citizenship Canada (IRCC) updated this information.
Out of over 2.2 million applications under processing, 897,100 were in backlog, exceeding the usual IRCC service standards.
This number was 892,000 for the month of March.
While 1,323,100 were being processed within IRCC service standards, the backlog increased only for temporary residence applications.
Applications for temporary residency backed up from 538,600 in March 2024 to 548,100 in April of the same year.
On the other hand, in March, there were 665,400 applications that met service standards; in April, there were 661,300.
The backlog of citizenship and permanent residence applications was actually reduced on a month-on-month based
The first quarter of 2024, Canada welcomed 121,620 new permanent residents, of whom 52,720 came to Ontario and only 17,745 to British Columbia.
Although the first quarter is too early to reach any conclusion, this number was 145,495 during the first quarter of 2023.
But, we can say immigration to Canada has cooled down as compared to last year, at least in beginning of 2024.
However, these numbers are higher as compared to the first quarter of 2022, during which the country welcomed 113,805 new permanent immigrants.
MANITOBA PROVINCIAL NOMINEE PROGRAM
The latest MPNP draw (Manitoba Provincial Nominee Program) of 2024, on May 2, sent out whopping 941 permanent residency invitations under various categories.
181 of the invited candidates in this MPNP draw had a valid Express Entry profile as well as a job seeker validation code.

CANADA INVITES IMMIGRATION CANDIDATES IN GENERAL EXPRESS ENTRY DRAW.
Immigration Refugees and Citizenship Canada (IRCC) has invited more candidates to apply for permanent residence (PR) through the Express Entry system.
The department issued 1,470 invitations to apply (ITAs) in a general draw for candidates from all Express Entry programs.
Candidates required a minimum Comprehensive Ranking System (CRS) score of 534.
IRCC held its second general draw of the month, inviting 1,490 candidates who had a minimum CRS of 535. These were followed by two targeted draws for healthcare and agriculture and agri-food occupations, which required candidates to have a CRS of at least 422 and 437 respectively.

IRCC says category-based selection not changing in 2024
In May 2023, the department introduced category-based selection rounds of invitations for candidates who can demonstrate that they met the criteria for one of six new Express Entry draw categories:
Healthcare occupations
Science, technology, engineering, and mathematics (STEM) professions
Trades occupations, such as carpenters, plumbers, and contractors
Transport occupations
Agriculture and agri-food occupations
Strong French proficiency
At the time of the announcement, the department said that it would review these categories and make any changes deemed necessary. As of February 13, IRCC has confirmed that these categories will not be updated in 2024
The categories were chosen following consultations with IRCC stakeholders such as a provincial and territorial governments, settlement services and Canadian businesses and employers.

PGWP Eligibility for Public-Private Partnership College Programs
In response to concerns regarding the quality of education and student support at specific public-private partnership college programs, the IRCC has implemented restrictions on PGWPs for these institutions.
PGWPs will no longer be available to students starting curriculum licensing agreement programs as of September 1, 2024.
While existing international students enrolled in these programs remain eligible for a PGWP, new enrollees will not qualify for post-graduation work permits.
This rule is meant to make sure that students get a good education and have a better chance at success in their careers later.

With 29,713 eligible candidates in the pool, there are currently 38,668 open slots under the Working Holiday Visa category for youth from 35 eligible countries.
This week, a total of 5,166 invitations to apply (ITAs) under the IEC 2024 season have been sent out in the three different categories.
The Young Professionals category received 274 closed work permit invitations in total and 237 invitations were delivered this week for the International Co-op (Internship) category.
As per the Immigration, Refugees, and Citizenship Canada (IRCC) most recent processing update on February 13th, the International Experience Canada (IEC) 2024 season is taking only 3 weeks to process.

What Happens After LMIA is Approved
After an LMIA application has been processed, employers will be issued a decision. If the employer is issued a positive LMIA, they can proceed with hiring a foreign national. If a negative LMIA is issued then unfortunately the employer is not approved to hire a foreign national.
Positive LMIAs are valid for 6 months from the date of issue. After receiving a positive LMIA, the employer must notify the foreign national so that they can apply for their work permit or permanent residence. In certain conditions, employers may apply to have their LMIA application processed in 10 days. To qualify for expedited processing, an employer must be located outside of Quebec and meet one of the following requirements:
Highest wage positions: top 10% of wages earned by Canadians in the province/territory of the job
Skilled Trades: paid at least the median provincial/territorial wage for the position.
Short-Term positions: 120 days or less
Express Entry: the LMIA is to assist an Express Entry candidate
Median Hourly Wages by Province or Territory
If an employer is hiring a TFW to be paid at or above the median hourly wage for their province or territory then they must go through the high-wage workers stream for LMIAs. If an employer is hiring a TFW to be paid below the median hourly wage then they must go through the low-wage workers stream.
Who is considered a minor child for a schooling visa?
The age of majority varies for every province and territory of Canada. Following is the categorization for age of majority across Canada:

How do I appoint a custodian?
To appoint a custodian, a declaration form from custodian is needed to be sent along with the study permit application.
As per IRCC guidelines, two pages of the form look similar, but:
the first page needs to be signed by the custodian and notarized (certified by a lawyer or notary) in Canada
the second page needs to be signed by the parents or legal guardians of the minor child and notarized in their home country
Furthermore, as per IRCC’s website, minors already in Canada may study without a study permit if they:
are in kindergarten, no matter what their parents’ status is in Canada
want to go to pre-school, primary or secondary school and have a parent who is allowed to work or study in Canada
are refugees or refugee claimants
have parents who are refugees or refugee claimants
came to Canada as a visitor for a course or program of studies of six months or less
will study in a course or program of six months or less
are in Canada by themselves

What are the requirements for the TRV?
An application for a TRV consists of Immigration, Refugees and Citizenship Canada (IRCC) forms. In addition to these forms, applicants must:
Pay the applicable processing and biometric collection fee
Submit the necessary supporting documents to accompany the application
The documents that may be required for the application include:
Photos of your passport
Proof of financial support
Photocopy of your return ticket or travel itinerary (if applicable)
Required documents may vary depending on the visa office responsible for your country or region.
How long is the TRV valid for?
If there is no stamp, date or document in your passport that indicates an expiry date, your status as a temporary resident will expire six months from the day you arrive in Canada.
What is the multiple entry visa vs the single-entry visa?
The multiple entry visa allows the holder to enter Canada from any country as often as necessary during the visa’s period of validity. It is issued with long-term validity to facilitate entry to Canada for legitimate travellers. This is the standard type of TRV.
The multiple entry visa has a maximum validity date of up to 10 years or 1 month before the expiry date on the travel document.
The single-entry visa is considered when an applicant is participating in a one-time special event in Canada for a short duration. Since the standard is the multiple-entry visa, any single-entry visa issuance requires the officer to provide an explanation for it.
How can you extend your stay?
You may apply online or use a paper application to extend your status as a temporary resident. It is recommended to submit your application for an extended stay in Canada at least 30 days before your status expires.
If your temporary resident status , you may remain in Canada under maintained status, which lasts until a decision is made on your Application!
What is criminal inadmissibility?
Immigration, Refugees and Citizenship Canada (IRCC) and Canadian Border Services Agency (CBSA) place massive importance on securing the borders from anyone who may pose a risk to the country. Therefore, they may deny entry to someone who is likely to commit a crime during their time in Canada.
If you are a foreign national and have been arrested or convicted of a criminal offense, you may be considered criminally inadmissible to Canada. If you have a past criminal charge in a foreign country, your admissibility to Canada is calculated based on the equivalency of the foreign offence into Canadian law.
If the offense translates to a summary offense, and it is your only criminal conviction, you may be considered admissible to Canada and not require permission to enter. If the translation is to one of an indictable offence, which can be defined as serious criminality, you may be considered criminally inadmissible to Canada.
How to overcome criminal inadmissibility
There are three main ways to overcome inadmissibility to Canada:
A Temporary Resident Permit application
A Criminal Rehabilitation application
A Legal Opinion letter
A Temporary Resident Permit (TRP) is an option if you are considered criminally inadmissible to Canada. The TRP grants temporary access to Canada for a determined period of time. A TRP is used in situations where a traveler has a valid reason for entering into Canada and the benefits of their entry outweigh any risks to Canadian society.
A TRP application can be granted for up to three years, depending on the reason of entry to Canada. A person can apply for a TRP anytime and it does not require the applicant to have completed their criminal sentence.
Canada allows foreign nationals with criminal history to submit a criminal rehabilitation application. This application permanently clears your past criminal history for the purposes of entering Canada. The criminal rehabilitation application is a one-time

How can I apply under the FSW program?
Interested candidates must submit an Express Entry profile to Immigration, Refugees and Citizenship Canada (IRCC). Submitting an Express Entry profile does not guarantee a candidate will receive Canadian permanent residence. Only after submitting an Express Entry profile will a candidate be assigned a CRS score and be considered in future Express Entry draws for Invitations to Apply (ITAs) for permanent residence.
When submitting your Express Entry profile, an FSW candidate will need to provide the following documents:
Educational Credentials Assessment (ECA)
In order to claim points for education, an FSW candidate must provide a valid ECA report attesting to the value of foreign education by Canadian standards. There are five organizations in Canada authorized to issue ECA reports. This is not required for educational credentials obtained from a Canadian educational institution.
Language Proficiency Test Results
All candidates under the Express Entry programs must provide results from an approved language test taken within the previous two years. Accepted tests for English include the IELTS exam, and the CELPIP exam (only available in Canada). Accepted tests for French include the Test d’Évaluation de Français (TEF) and the Test de connaissance du français pour le Canada (TCF Canada).
Identification Documents
Candidates will be required to provide information from identification documents. Ideally, a candidate and all accompanying family members should possess passports valid for travel.
If a candidate is successful in receiving an Invitation to Apply (ITA) for Canadian permanent residence, they will move onto the second stage of the application process. In this second stage, the applicant will have 60 days to prepare and submit an electronic Application for Permanent Residence (eAPR). This application requires further documentations.
Who is eligible to apply under the FSW program?
In order to qualify for the FSWP, a candidate must meet certain minimum requirements regarding years of experience, level of education, age, and English or French language proficiency:
Work Experience
At least 12-months of continuous, full-time, skilled work experience completed within the previous 10 years (or an equal amount in part-time experience).
Skilled work experience refers to experience classified under NOC Skill Level 0, A, or B.
Language Proficiency
Reach a minimum of Canadian Language Benchmark (CLB) level 7 on an approved English or French language test.
Education
A minimum of a Canadian high school diploma or the equivalent in foreign education.
Financial Support
Enough funds to support themselves and any spouse and/or children in their settlement in Canada.
Residence in Canada
Must intend to live outside of the province of Quebec.
If a candidate meets the requirements listed above, they must also demonstrate that they score a minimum of 67 out of 100 points on the FSW eligibility points grid.
Provided a candidate meets these requirements, they will be eligible to submit an Express Entry profile for the Federal Skilled Worker program. However, candidates should note that they must meet Canada’s basic admissibility requirements. Certain criminal offences and medical conditions may make a person inadmissible to Canada.
