Способ 1: иностранный брокер
Российские инвесторы могут вкладываться в американские акции, если откроют счета у иностранных брокеров. Для того чтобы торговать ими, россиянам по-прежнему доступен сервис Interactive Brokers, однако он действует с некоторыми ограничениями, говорит экономист, бывший старший вице-президент банка «Открытие» Константин Церазов. В частности, из-за санкций брокерская компания не принимает переводы в рублях, соответственно, пополнить торговый счет с рублевого счета не получится. Но зато это можно сделать в других валютах, говорит Церазов.

В целом услуги иностранных брокеров и до санкций против СПБ Биржи пользовались повышенным интересом, говорит руководитель управления развития клиентского сервиса ФГ «Финам» Дмитрий Леснов. «Это было связано с их большим выбором инструментов и возможностей, а также надежностью — это крупные финансовые институты, при этом в большинстве юрисдикций у клиентов брокерских компании есть страховка на случай банкротства», — говорит он. Но сейчас, когда ограничения для российских инвесторов постоянно ужесточаются, иностранные брокеры не выглядят уже столь привлекательными, добавляет Леснов.

Поэтому, когда СПБ Биржа попала под санкции и остановила торги иностранными активами, инвесторы приняли это спокойно и всплеска спроса на брокерские счета за рубежом не было, говорит управляющий партнер Smartly LLC, UAE Вадим Погосьян. Он отмечает, что выбор страны, где будет открыт брокерский счет, зависит от финансовых возможностей инвестора. «Инвесторы с капиталом поменьше, $5000–10 000, предпочитают открывать счета в странах СНГ. Те, кто побогаче, — в ОАЭ, Гонконге или Европе, но при наличии европейского вида на жительство. Самые состоятельные клиенты выбирают Сингапур — там счета открывают всем, но требуют чек около $15 млн», — рассказывает Погосьян.

Инвесторам стоит учитывать, что при работе с активами, где так или иначе задействована европейская инфраструктура, будут действовать ограничения на размер вложений — не более €100 000, напоминает Дмитрий Леснов из «Финама». В американских компаниях таких ограничений нет, но есть другие — например, связанные с использованием заемных средств брокера, говорит Леснов.

При этом инвесторам стоит учитывать, что торговля иностранными ценными бумагами через иностранных брокеров сопряжена с рисками, говорит директор Main Partner Trust Алена Сахарова. К стандартным рискам инвестирования с 2022 года добавились еще и санкционные, которые, как показывает практика, могут настигнуть инвестора в любой стране. «Последний пакет санкции США против России показал новый тренд в борьбе с обходом санкций — включение в списки брокеров, нарушающих санкционное законодательство. Одним из примеров стал брокер из ОАЭ, компания ARX Financial Engineering Ltd, которая базировалась в Дубае. Компания предлагала стандартный набор брокерских услуг российским клиентам», — говорит она.

Способ 2: российский брокер
Сейчас единственный российский брокер, который предоставляет доступ напрямую к торгам американскими активами, — это «Финам». Forbes подробно рассказывал о том, как брокеру удалось создать инфраструктуру, позволяющую это делать.

И сейчас, когда инфраструктурные и санкционные риски за рубежом серьезно выросли, в «Финаме» наблюдают переток клиентов из иностранных брокеров в Россию. «За последний период в «Финам» пришло немало клиентов иностранных брокеров. Их переход был вызван множеством барьеров, которые им были выставлены иностранными брокерами», — говорит директор по развитию ФГ «Финам» Алексей Бербеницкий.

Брокер дает доступ к американским акциям и опционам. Торговать этими инструментами, согласно российскому законодательству, могут только квалифицированные инвесторы. В описании услуги говорится, что брокер дает прямой доступ к биржам NYSE, Nasdaq, CBOE, в общей сложности к 20 000 инструментам.

Торги ведутся на платформе Lime Trading. Брокер подчеркивает, что активы хранятся в надежном зарубежном депозитарии без риска блокировки в российской инфраструктуре. Где именно — не уточняется, про риски выстроенной таким образом иностранной инфраструктуры в описании продукта также ничего не сказано.

Интересным вариантом для вложений могут быть фьючерсы на западные индексы, говорит портфельный управляющий по глобальным рынкам, заместитель директора по инвестициям и управлению General Invest Михаил Смирнов.

Например, это фьючерсы на американские индексы S&P и Nasdaq, а также немецкий DAX. Правда, это фьючерсы не совсем на индексы — а на индексные FTF, торгуемые на зарубежных площадках. Например, ставку на американский индекс S&P 500 можно делать через фьючерс на инвестиционные паи SPDR S&P 500 ETF Trust, который старается отслеживать американский индекс.

Оборот по этому контракту с ближайшей датой исполнения в декабре за последний месяц составил 75 млрд рублей. Для сравнения: оборот за тот же период по фьючерсу на индекс Мосбиржи с той же датой исполнения составил 318 млрд рублей, а по контакту на индекс РТС — 325 млрд рублей.

Зато у этих инвестиций почти нет возможности быть заблокированными из-за санкций. «Они имеют низкие инфраструктурные риски, так как многие контракты являются расчетными и не требуют операций с иностранными ценными бумагами, даже если основным активом является, например, индекс S&P 500».
