Edwards v Skyways Ltd [1964] 1 WLR 349
Facts: Skyways Ltd promised their employee an ex gratia payment if their employee agreed not to claim his entitlement to his entire pension as part of his redundancy agreement. However, Skyways later refused to make the payment, arguing that their inclusion of the phrase ‘ex gratia’ indicated a lack of intention to create legal relations. Ratio: The Court of Appeal held that the agreement did possess intention to create legal relations, as it was a commercial agreement and the term ‘ex gratia’ did not prevent the defendants from being bound by their agreement. Application: The term ‘ex gratia,’ in Latin, means ‘by favour.’ In this case, the court interpreted it as removing any possible pre-existing liability on the defendant’s behalf; however, it did not entitle them to refuse payment to their former employee.

Who Defined Murder?

Sir Edward Coke's (Institutes of the Laws of England, 1797) traditional definition of murder is as follows:

“Murder is when a man of sound memory, and of the age of discretion, unlawfully killeth within any country of the realm any reasonable creature in rerum natura under the King’s peace, with malice aforethought, either expressed by the party or implied by law, so as the party wounded, or hurt, etc. die of the wound or hurt, etc. within a year and a day after the same.”

For the sake of simplicity, we can define murder as the unlawful killing of a human person under the Queen's peace with malice aforethought.
