Meet Justin Osei. Justin joined the Family team as a Solicitor at our Tiverton Office in February 2024 and has worked within the family law sector since 2021. He was admitted to the roll on 12 February 2024, having trained at a specialist family law firm based in North Devon. Justin attended the University of Bedfordshire and was awarded a 2:1 with Honours LLB Law Degree. Following this, he studied the Legal Practice Course alongside a masterโs degree in law at the University of Law in Bloomsbury, London. Justin is also an accredited Police Station representative.
Justin has experience working with clients who are going through divorce, financial separation, domestic abuse, and private children matters.
Justin appreciates that family matters can be difficult and stressful and empathises with every client who is in a difficult situation and requires his assistance. Given that these circumstances are often difficult, he aims to try to resolve most issues as swiftly and cost-effectively as possible where the desired outcome can be achieved. Where this is not possible, Justin will take more robust options to ensure that there is progress, where possible. Justin enjoys providing his clients with friendly reassurance in times of uncertainty and delivering great outcomes.

Meet Gay, who has been a Partner at the firm for many years, and is based at both our Exeter and Tiverton offices. She has acted in a large number of complex Will and Estate Disputes over the last two decades, representing family members, beneficiaries, and professional trustees, often in the High Court.
She has wide-ranging knowledge and experience in this area and focuses on finding a solution to even the most seemingly intractable disputes, where emotions are often running high. She also deals with lifetime disputes regarding capacity, undue influence, and fraud, and the exercise of powers by Trustees and Attorneys.

Meet Julia who is a partner in the Commercial Property team and joined Everys in 2024. Julia splits her time between the firmโs Exeter and Tiverton offices.
Qualifying in the South East in 2005, Julia has been practising in the South West since 2009 and has nearly 20 yearsโ experience of dealing with a wide range of commercial property work. Juliaโs work includes sales and acquisitions, including options and conditional contracts, the taking and granting of leases, and secured lending.
Outside of work, Julia enjoys being by the sea, the theatre, and spending time with her young son.

Meet Alex Whitmore, an Associate in our Residential Property team based in Tiverton. He joined Everys as a paralegal in 2017 and embarked on his training contract in 2018. Alex was admitted as a solicitor on 1st April 2020.
Alex has a broad experience of residential property, from freehold and leasehold sales and purchases to dealings with unregistered land, transfers of part, and residential lease extensions. Alex also has experience working for a wide range of clients, from first-time buyers to those purchasing leasehold retirement flats.

Meet Rozina Eulberg, a Solicitor in our Private Client department who is based at our Tiverton office. She joined Everys in January 2023 from a large regional firm in Taunton and works on complex estate administration. She enjoys working with agricultural clients, family businesses and working with families to administer estates in a timely and tax-efficient manner. It has been a long time coming, but today sees the implementation of mandatory mediation for small claims matters, i.e. monetary claims with a value of up to ยฃ10,000. Parties to a litigated dispute will need to have attended a mediation appointment to try and settle the matter before being able to proceed to a Court Hearing.
It is anticipated that this free telephone service provided by the Courts will result in at least half of small monetary claims settling amicably within a matter of weeks, rather than up to a year via a Court Hearing. It is important to note that issuing a Claim Form will still attract the usual Court Issue fee. It is noted that the intention is to increase the use of mediation in higher value claims as well using external mediators.
On the basis that it is still cheaper and speedier to mediate pre-litigated cases, Everys Mediation Service firmly advocates the use of mediation at an early stage to settle disputes amicably. We can assist on both pre-litigation and issued small claims matters and higher value claims at a competitive rate.

โข Permanent Lack of Capacity: For example, Bryan, with his mild dementia, forgets how much he has spent on his shopping. His financial decisions are forever altered.
โข Short-Term Lack of Capacity: Alice, hearing distressing voices, struggles with day-to-day activities during those moments. Her capacity fluctuates - this is often referred to as someone who has good days and bad days, or good episodes and bad episodes.

As we observe Dementia Action Week (May 13th-19th), letโs not only raise awareness but also emphasise the critical connection between dementia care and estate planning. ๐
๐ Understanding Dementia: Dementia isnโt just an โold personโs disease.โ It is a complex set of symptoms affecting memory, language, problem-solving, and behaviour. Whether itโs Alzheimerโs disease or another form of dementia, the impact is profound. We need to recognise that dementia can strike at any age, affecting peopleโs lives and their ability to make decisions.
๐ Why Review Your Will? It is important for families to review their Wills in light of a family member's diagnosis and to ask if their Wills still do what they intended them to do given the diagnosis. For example, do you want to leave more to the person who has received the diagnosis (e.g. your spouse) to provide for the care you want them to have? Or do you want to provide less to that person and redirect your estate to other family members, e.g. from your spouse to your children, or make a different split of your estate? There is not a right or wrong way, but it is sensible to review it on receipt of the diagnosis then the focus can be the planning of care, support and time together.

During Dementia Action Week, letโs shine a spotlight on the critical intersection of dementia care and legal protection. ๐
๐ Understanding the Court of Protection: The Court of Protection, established under the Mental Capacity Act 2005, plays a pivotal role in safeguarding the rights of individuals who lack the capacity to make decisions for themselves. Whether itโs financial matters, healthcare choices, or living arrangements, the Court steps in to ensure their best interests are upheld.
If your loved one has not made a Power of Attorney, and lacks capacity to make decisions regarding their finances or health matters, it may be appropriate to apply to the Court of Protection to ask the Court to appoint you or someone else to be their deputy. This will allow you to act on their behalf in the same way that an attorney might.
If you are not sure what you or your loved one needs, seek legal advice from a Solicitor that specialises in later life matters.
