BOOST&UP is similar to the Trademark FAST&UP.
A Single judge bench of Delhi High Court passed an injunction order against the trademark and logo BOOST&UP which was copied from a registered and well-known trademark FAST&UP. Aeronutrix Sports Products Pvt. Ltd., the owners of the trademark FAST&UP had filed a suit in Delhi High Court in order to protect its trademark rights and Copyright. FAST&UP was represented by Sumit Nagpal Aastha Sood and Dolly Luthra from Nagpal & Associates (Advocates & Solicitors)
The bench of Justice Hon'ble Mr. Justice Amit Bansal ordered “in my prima facie view, the trademark/logo and the colour scheme being used by the defendants are deceptively similar to that of the plaintiff and the only distinction seems to be word ‘FAST’ being replaced with word ‘BOOST’. The plaintiff has made a prima facie case in its favour for grant of ex parte ad interim injunction. Balance of convenience is in favour of the plaintiff. Irreparable harm and injury would be caused to the plaintiff if the ex parte ad interim injunction is not granted in favour of the plaintiff.”
