Today, a young associate in our firm approached me, hesitantly. "I might need a day off next week," she began, expecting tons of questions or a refusal. Before she could explain further, I simply replied, 'That's alright. Take the time you need.'

कृष्ण जन्मभूमि केस

आज माननीय सर्वोच्च न्यायालय के समक्ष कृष्ण जन्मभूमि मुक्ति निर्माण ट्रस्ट का वरिष्ठ अधिवक्ता श्री गौरव भाटीया, श्री सार्थक चतुर्वेदी, श्री हिमांशु त्रिपाठी, श्री उत्कर्ष जायसवाल, विकास तिवारी ने पक्ष रखा और बड़ी जीत हुई।

माननीय सर्वोच्च न्यायालय ने दोहराया कि याचिकाकर्ता के मामले सहित सभी 10 वाद को उच्च न्यायालय के आदेश के अनुसार अंतिम सुनवाई के लिए माननीय उच्च न्यायालय में स्थानांतरित कर दिया गया है। (एसएलपी लंबित है)

माननीय सर्वोच्च न्यायालय ने अपने आदेश में कहा है कि माननीय उच्च न्यायालय ही स्थानीय आयुक्त की नियुक्ति से संबंधित मुद्दे पर फैसला करने वाला एकमात्र सक्षम न्यायालय होगा।

प्रिंट मीडिया में यह गलत खबर चल रही है कि वैज्ञानिक सर्वेक्षण की याचिका माननीय सर्वोच्च न्यायालय ने खारिज कर दी है। सही स्थिति यह है कि मूल मुकदमे को खारिज करने की प्रार्थना करने वाले दूसरे पक्ष के आवेदन पर सुनवाई से पहले स्थानीय आयुक्त की नियुक्ति के आवेदन को गुण-दोष के आधार पर विद्वान ट्रायल कोर्ट, मथुरा द्वारा सुनने से इनकार कर दिया गया था। ट्रायल कोर्ट के उस आदेश के खिलाफ, माननीय उच्च न्यायालय में एक आवेदन दायर किया गया था। अनुच्छेद 227 के तहत उक्त आवेदन खारिज कर दिया गया था जिसे माननीय सर्वोच्च न्यायालय के समक्ष चुनौती दी गई थी। इस बीच, मूल मुकदमा उच्च न्यायालय में स्थानांतरित कर दिया गया। *माननीय उच्चतम न्यायालय ने आज कहा कि उच्च न्यायालय गुण-दोष के आधार पर सर्वेक्षण आवेदन पर निर्णय लेने के लिए उपयुक्त मंच होगा क्योंकि यह अब प्रथम दृष्टया न्यायालय यानी ट्रायल कोर्ट बन गया है।
सर्वेक्षण के लिए स्थानीय आयुक्त की नियुक्ति के आवेदन पर अब तक किसी भी न्यायालय ने गुण-दोष के आधार पर सुनवाई नहीं की थी।
इसलिए यह रिपोर्ट करना कि सर्वेक्षण के लिए आवेदन खारिज कर दिया गया है, कानूनी रूप से गलत है। *अब तक किसी भी अदालत ने सर्वेक्षण के आवेदन पर फैसला नहीं किया है।
मूल मुकदमे की अस्वीकृति की प्रार्थना करने वाले दूसरे पक्ष के आदेश 7 नियम 11 सीपीसी के तहत आवेदन से पहले योग्यता के आधार पर सुनवाई के आदेश 26 नियम 9 सीपीसी आवेदन को प्राप्त करने के लिए प्रक्रियात्मक आधार पर अपीलीय अदालत के क्षेत्राधिकार का इस्तेमाल किया गया था।

Today in a very prestigious matter of Shri Krishna Janambhoomi, Mathura We appeared on behalf of the Petitioner For Shri Krishna Janambhoomi Mukti Nirman Trust, We thank Sr Advocate Shri Gaurav Bhatia Sir, who appeared in this matter and argued the case in favor of Santan Dharm and Shri Krishna Janambhoomi. Having heard the matter, the court directed the petitioner to initiate a fresh application under order 26 rule 9 CPC before the Hon'ble High Court of Judicature of Allahabad.
