The Kerala High Court on Monday held that when the body of the victim is manipulated to simulate a sensation akin to pe*******on of an or***ce, the offence of r**e is attracted.
The decision was rendered by the Court in a matter that involved unfortunate instances of repeated sexual assault of various degrees on a minor girl by her neighbour. The Bench was hearing an appeal filed by Accused against his conviction under sections 3(c) r/w 5(m), S.6,S.9(l) (m) r/w S.10, S.11(i) & (iii) r/12 of POCSO Act and under S.354,354A(1)(i) &(iii),377,375(c) r/w S.376(2) (i) of IPC. After trial, he was found guilty for the offences under S11(i) r/w 12, 9(l) (m) r/w. 10, S. 3(c) r/w 5 (m) and S.6 of the POCSO Act, S. 375(c) r/w Sections 376(2) (i), 377, 354, 354A(1)(i) of IPC. He was sentenced to imprisonment for life by the Trial Court.

The Supreme Court on Wednesday directed the Institute of Chartered Accountants of India(ICAI) to give "opt-out" option to a candidate in the CA exams,scheduled to start from July 5, on account of COVID-related difficulties for herself or her family members, on the basis of a medical certificate issued by a registered medical practitioner.

The Court also did away with the ICAI's requirement of producing RT-PCR certificate for seeking "opt-out.

The late Smt. Durgabai Deshmukh first emphasised the need for family courts in India following a tour of China in 1953, where she studied the operation of family courts.
Another reason for the establishment of family courts was the mounting pressure from various women's associations, welfare organizations, and individuals to establish such courts in order to provide a forum for the quick resolution of family-related disputes.

The matrimonial litigation process is a traumatic experience for both parents and their children. Aside from emotional issues, it causes numerous legal, social, and practical complications.

 Keeping in view the high rate of marital discord, several matrimonial reliefs have been provided in the Hindu Marriage Act, 1955.
Some of them are restitution of conjugal rights under Section 9; judicial separation to help calm tempers under Section 10; classification of marriages as void under Section 11 and voidable under Section 12 for nullity of legally irregular marriages; and finally, divorce under Section 13 of the Act.
Provision has also been made to assist the victim spouse with maintenance pendente lite and proceedings expenses under Section 24, permanent alimony, and maintenance under Section 25.

Thus, the preservation of marriage should be regarded as a priority, as it is the fundamental and one of the most important institutions of society. Problems come to strengthen us, so it is up to us whether we surrender to them or take a stand to bring positivity into our lives.
