In a divorce case involving allegations of cruelty by the wife, it was observed that the parties cohabited for only about two months. The husband did not aver that the wife had lodged any complaints or taken legal action against him or his family members. Furthermore, the accusations of misbehavior by the wife lacked substantiation through specific incidents or dates, and the husband failed to provide names or details of the alleged individuals involved in the wife's purported affair. Moreover, photographs submitted by the husband were deemed questionable, and the husband did not present a certificate under Section 65-B of the Evidence Act regarding WhatsApp chats. Consequently, the Delhi High Court in AIROnline 2024 DEL 12(A) concluded that the husband had not adequately demonstrated the cruelty allegedly inflicted by the wife, ultimately ruling in favour of the wife in the divorce proceedings.
A landlady (complainant) filed a complaint against her tenant (accused) for a dishonored cheque meant for rent and electricity payment. The cheque bounced due to insufficient funds. The accused claimed the cheque was stolen after being issued for vehicle insurance to an agent. The Delhi High Court in AIROnline 2024 DEL 2 found the complainant’s case weak. There were inconsistencies in her statements about the purpose of the cheque, and she lacked evidence regarding the specific breakdown of the amount (rent vs electricity). Since the complainant failed to establish a legally enforceable debt, the explanation of accused, even if questionable, successfully rebutted the claim. The court concluded that the acquitta of accusedl was proper.
