In 2019, Flash Electronics, a key supplier of technology for leading companies like Yamaha and BMW, had filed a suit against Royal Enfield (RE) for patent infringement regarding a regulator rectifier device. It regulates the output voltage, efficiently converting AC voltage from the engine into DC voltage.
RE claimed otherwise that an external vendor supplied the technology, but the vendor claimed it to be false. At one point, Flash was even approached by 3 senior officials of RE to try and settle the dispute peacefully. USPTO then charged RE for infringement on Flash Electronics’ patent.
Due to Flash Electronics strong portfolio and having filed patents in multiple countries, Royal Enfield could not touch them.

If you are evaluating patent technologies in this sector, consider our experts at Arctic Invent. We will assist you in patenting technologies, drafting applications and designing patent portfolios.
An AR hat? Not just an AR glass anymore? Well, Facebook has done something quite innovative. Their patent on the "AR hat" is turning heads around. The smart glasses attach to the hat's visor and can fold when not in use. How handy is that!!
What are investors looking for in your patent?
1. Uniqueness - Investors are looking for patents with unique features that can be protected and monetized.
2. A strong IP portfolio- a well-written application can cease several prior art references cited against it. A patent attorney can help do that for you, making the portfolio seem less broad and mainstream.
3. Number of applications filed - If the company has filed several applications, it tells the investor that the IP may not be valuable and the patent applications may not be granted. Hence he can lose interest to invest.
4. Roadblocks- Investors would like to know if your product is capable of entering the market and that there aren't any major roadblocks that you are unaware of. So, maintain a strong portfolio while he scrutinizes your IP.
5. Competent attorneys- Investors would prefer that an experienced attorney, knowledgeable in handling complex portfolios is handling your papers. Investors may have their patent attorneys too, looking at your portfolio’s quality over price. It is also important to note that hiring an affordable attorney such as Arctic Invent’s attorneys, will ensure a sense of resource-saving to the investor.

Office Ergonomics. Did it occur to you too? It did to Joel Heath. He founded Fluidstance in 2014 that makes ‘Standing desk Balance boards’. He was tired of sitting down all day at work, conferences and board meetings. This idea serves the purpose to help one to exercise and yet work at the same time, burning calories at a 10% faster rate and a 15% increase in heart rate. Since the first patent grant in 2016, the company has patented over 13 other standing desk boards.
Due to its stunning creativity and innovation, the company’s revenue is now over 9M USD.
Considerations, before you file your patent in other countries-
1. Is your patent valuable enough to consider protecting them in foreign jurisdictions? An International patent can be expensive. Evaluate the ROI above all.
2. Patentability- Few features/technology aspects of the invention cannot be protected in some countries, hence it is advisable to consult a patent attorney before you get started so that precious time and effort is optimised.
3. Time Factors- international patent applications take a long time to be granted. Will your product still be as valuable, till your international patent is granted? Would your current patent expire before the foreign one is granted? Think on such lines too.
4. Post-launch potential market share. Consider the competitors market share in that region and analyze whether it is possible/feasible, to compete in the same market- providing close to similar products.
5. Your income and budget- Your ROI should be greater than your patenting costs after your product has been commercialized so that you don’t incur losses.

iRobot had filed another lawsuit this march, recent being January, where they alleged that Shark Ninja had infringed on 5 of its patents on the Roomba, a floor cleaning bot.
The autonomous cleaner's inventors claimed that Shark Ninja had copied and implemented them in their products. However, the latter claimed that iRobot is trying to monopolize the market instead. The USICT is probing the matter and the results can be expected soon.
Who will win? iRobot or Shark Ninja?
Here are few funding initiatives that can help you. With the emerging scope for robotics in India, a funding process/ grant is going to be helpful for startup innovators in this field.
