Kenyans without biometric passports to be barred from travelling in December!!

“Pursuant to the decision by EAC Council of Ministers held in Arusha from November 22 to 29, 2021, the deadline for phasing out of the old generation passport for EAC Member States is November 2022 In line with this decision, the Directorate of Immigration Services wishes to inform the general public that Kenya is bound to migrate to the new East African Community biometric e-passport by November 30." DG Alexander Muteshi.

Already, some countries like Spain and others in the European Union (EU) are not accepting the old passport from Kenyan travellers, adding to the confusion that has been occasioned by several postponements.

Regaining of Kenya Citizenship

•Regaining Kenya citizenship is done by a person who was a citizen of Kenya by birth and who ceased to be a citizen of Kenya because he or she acquired the citizenship of another country before 27th August, 2010. Kenyan citizens by birth who lost their Kenyan citizenship can apply to regain through https://fns.immigration.go.ke/infopack/citizenship/regaining.

N/B: Those who lost citizenship should not apply for a Kenyan ID or a passport until they regain their Kenyan citizenship.

•The core function of the Permits Section is the processing and issuance of work permits and passes. There are various classes of permit as provided under the enabling regulations.
•The Section derives its mandate mainly from the Sections 36, 40, 41, and 42, of the Kenya Citizenship and Immigration Act 2011 and the attendant Regulations.

Applications Submission and Collection

•All applications for Permits and Passes are made and submitted online accompanied by all the necessary requirements which should be uploaded.
•Applicants can print out their own Permits and Passes from their eFNS Accounts once they are processed and issued.

Declaration made by a dual citizen.

-Section 8(3) of the Kenya Citizenship and Immigration Act, 2011 provides that: every dual citizen shall disclose his/her other citizenship in the prescribed manner within three months of becoming a dual citizen.
-Section 8(4) of the Kenya Citizenship and Immigration Act, 2011 provides that: a dual citizen who fails to disclose the dual citizenship in the prescribed manner commits an offence and shall be liable, on conviction, to a fine not exceeding five million shillings or imprisonment for a term not exceeding three years or both.

Application for registration as a citizen of Kenya by a spouse of a Kenyan citizen.

-Section 11 of the Kenya Citizenship and Immigration Act, 2011 provides for a person who has been married to a citizen of Kenya for a period of at least seven years shall be entitled, on application, in the prescribed manner to be registered as a citizen of Kenya, if

•the marriage was solemnized under a system of law recognized in Kenya, whether solemnized in Kenya or outside Kenya;
•the applicant has not been declared a prohibited immigrant under this Act or any other law;
•the applicant has not been convicted of an offence and sentenced to imprisonment for a term of three years or longer;
•the marriage was not entered into for the purpose of acquiring a status or privilege in relation to immigration or citizenship; and
•the marriage was subsisting at the time of the application.

Am I a citizen by birth because I have a birth certificate?

No as a Birth Certificate is not a document of citizenship. A person is a citizen by birth if at the date of his or her birth; one of the parents is or was a citizen of Kenya. This is regardless of where the person is or was born.

Kenya Dependent’s Pass (KDP)

This is a document issued to a person whose spouse, child, parent or guardian is lawfully entitled to enter and remain in Kenya in accordance to the Kenya Citizenship and Immigration Regulations, 2012 Section 27 (1). For children the age limit is 21 years except for those in full time education institute or mental and physical incapacity.

Dependant Pass

The Kenya Citizenship and Immigration Regulations, 2012 provides that an immigration officer shall not issue a dependant's pass unless he or she is satisfied that:

a) The person, on whose behalf the application is made, depends on the person making the application for his or her maintenance;

b) The dependant is a spouse or child of the applicant or is by reason of age, disability or any incapacity unable to maintain himself adequately or for some other reason relies upon the applicant for his or her maintenance

c) The applicant has an income sufficient to enable him or her to maintain and continue to maintain the dependant for the duration of the dependant’s stay in the country.

The Dependant’s pass is issued to persons who are Dependants of:

•Kenya Citizens
•Permit holders
•Exempted persons
•Permanent residents

The following are the necessary requirements to enable one obtain a Dependant’s pass:

1. Duly filled and signed Form 28 - Dependant Pass, which should be filled online, printed out and signed;

2. Detailed and Signed Cover letter from the applicant addressed to the Director of Immigration Services;

3. Two (2) recent colored passport size photographs of the dependant;

4. Copy of a valid national passport / National ID for both the applicant and the Dependant;

5. Evidence of the relationship between the applicant and the dependant, being a Copy of Marriage Certificate, Birth Certificate e.t.c.

6. Proof of sufficient and assured income to sustain self and the dependant.

7. Processing fee of K.shs. 5, 000.00.

Once the application and all supporting documents listed above are received by the Authority, an immigration officer shall after considering the application made issue a dependant's pass in Form 29 which shall entitle the dependant in respect of whom it is issued to enter into Kenya within the period specified in the pass and to remain in Kenya during the validity of the pass.

Kenyan permanent Residency as a spouse of a Kenyan citizen.

PR is available to foreign spouses of Kenyan nationals. In order to apply, you must have been married to a Kenyan citizen for at least three years. Kenyan immigration services state that applicants must provide the following information with your application:

•An application letter written by their Kenyan spouse.
•A printout of the duly filled permanent residence application form (Form 23) signed and stamped by Magistrate/Commissioner for oaths Category.
•Questionnaire for Intending Applicants (this is generated when you complete the online application)
•Completed residence status form generated automatically upon completion of the online application.
•Police Clearance Certificate (Original)
•Evidence of marriage (copy of the marriage certificate)
•Copies of either passport/Identity card/ and birth certificate of your Kenyan spouse.
•Copy of passport /birth certificate/ of your foreign spouse.
•Copies of work permit(s)/dependant pass of your spouse.
•Two passport size photographs (a soft copy will also be required during application)
•Copy of valid foreigner certificate (Alien card)
•Copy of the Police Clearance Certificate.

NOTE that as with all spouse immigration applications, the person processing your case will be looking for any potential signs that your relationship (and hence the application) is not genuine; this is often referred to as ‘sham marriage’. For this reason, try to include plenty of evidence with your application that your marriage is genuine and ongoing. Evidence such as photos and proof of your shared finances and future plans should be provided to give a clear picture of your genuine relationship.

Visa photo(s) conditions and requirements.

The photo must be;

•In colour

•Sized such that the head is between 1 inch and 13/8 inches (22 mm and 35 mm) or 50% and 69% of the image's total height from the bottom of the chin to the top of the head.

•Taken within the last 6 months to reflect your current appearance.

•Taken in front of a plain white or off-white background.

•Taken in full-face view directly facing the camera.

•With a neutral facial expressions and both eyes open.

•Taken in clothing that you normally wear on a daily basis.

•Uniforms should not be worn in your photo, except religious clothing that is worn daily.

•Do not wear a hat or head covering that obsecures the hair or hairline, unless worn daily for religious purposes. Your full face must be visible, and the head covering must not cast any shadows on your face.

•Headphones, wireless hands-free devices or similar items are not acceptable in your photo.

•Eyeglasses are no longer allowed in new visa photos, except in rare circumstances when eyeglasses cannot be removed for medical reasons; e.g. the applicant has recently had ocular surgery and the eyeglasses are necessary to protect the applicant's eyes. A medical statement signed by a medical professional/health practitioner must be provided in these cases. If the eyeglasses are accepted for medical reasons:
-There must not be glare on eyeglasses that obscures the eye/s.
-There must not be shadows or reflection from the eyeglasses that obscures the eye/s.

•If you normally wear a hearing device or similar articles, they must be worn in your photo.

Clarification on Temporary permits:

_After doing an online application on https://www.ecitizen.go.ke, Print the applications and attach the required documents, that is the Original ID and copy, Birth certificate and 3 passport size photos.
_Submit them at Immigration desks for approval, that can be done from Border points, Airports or Nyayo house (HQ), Mombasa or Kisumu regional offices.

3-Copy of applicant’s national ID card (For person’s aged 18 years and above)
