Future UN Convention on Countering the Use of ICTs for Criminal Purposes is doomed to success

Article by the Deputy Head of the Russian Delegation to the Ad Hoc Committee to Elaborate a Comprehensive International Convention on Countering the Use of ICTs for Criminal Purposes, head of section of DIIS of Russia’s MFA, Mr. Ernest Chernukhin
The objective transition of humankind to the virtual environment is accompanied by a breakdown of many existing stereotypes about the functioning of the mechanisms of interaction between states, society and business. This, in turn, requires adjustment and creation of new contours for ensuring the security of states.
At the same time, there are changes associated with the transformation of the global information order. The leading industrialized powers are trying to maintain their status as the dominant force in the information field and slow down the transition to a polycentric model of its management based on legally binding norms, rather than on some rules that can be changed to suit the political conjuncture.
The absence of relevant universal international legal treaties in this area has led to a huge wave of crime in the information space, with serious damage to the economic activity of states and the well-being of millions of people. Thus, according to independent international experts, the annual damage from the activities of criminals in the information space of EU Member States alone is about 5.5 trillion euro.
ICT crime has become a profitable business. There has been a tendency of incitement by some states to take illegal actions against others, and to place ready-made malware in the public domain of the Internet by these states. The prospects for the global digitalization process as a whole, the effectiveness and dynamics of which depend on ensuring security, are in question.
It is against this background that the work of the UN Ad Hoc Committee for the Elaboration of a Comprehensive International Convention on Countering the Use of Information and Communication Technologies (ICTs) for Criminal Purposes is taking place. This negotiating mechanism was established at the initiative of Russia, with the co-sponsorship of 46 and support of 87 states, by UN General Assembly resolution 74/247. It is aimed at creating by the world community the first ever universal and legally binding instrument to combat crime in the information space.
Paradoxically, even in the current political realities, the work of the Ad Hoc Committee, due to the cross-border nature of ICT crimes, has become even more relevant and in demand for most states of the world. The sessions were attended by subject matter experts from more than 160 states and 200 non-governmental organizations representing political and law enforcement agencies, as well as academic, scientific and business communities.
Since the very establishment of the Ad Hoc Committee, Russia has been and is still in favour of elaborating such a comprehensive treaty that would lay the foundations for effective and transparent international cooperation to combat this threat. The Convention to counter the use of ICTs for criminal purposes, drafted under the auspices of the UN, should give consideration to the interests of all states without exception and be based on the principles of state sovereignty protection, equality of parties and non-interference in the internal affairs of states. It should also provide for a broad scope and criminalization.
At the same time, the United States, the EU and their allies, at all stages of the discussions, strongly opposed the establishment of such a specialized UN body in general and the development of a convention in particular, and voted against the establishment of an ad hoc committee at the UN General Assembly. One of the formal arguments of the West countries was that “the world is not yet ready for such a convention.”
The hidden informal reason for rejecting the very idea of a UN treaty was the 2001 Council of Europe Convention on Cybercrime, developed at the instigation of the United States, known as the Budapest Convention, whereby Washington undermines state sovereignty and controls the Member States information space. After all, the future universal UN treaty becomes a direct competitor to the Budapest Convention and can put an end to the “chosenness” and ambitions of technologically developed states.
Having lost the vote for the “minds and hearts” of the developing world at the 74th session of the UN General Assembly, the United States and its allies completely changed their approaches, declaring that “the world needs such a convention.” They tried to quickly realign themselves and take the lead in drafting the UN convention. Thus, Washington and its allies moved from direct rejection of the idea of a future convention to tactics of covert sabotage and emasculating the content of the international treaty from within.
In contrast to Russia, Washington advocates maximum harmonization of the UN and Budapest conventions. This means that instead of a comprehensive approach, as enshrined in the mandate of the Ad Hoc Committee, the countries of the collective West are agitating for a narrow scope and criminalization, and are aggressively imposing gender and human rights issues. Thus, the United States is trying to breathe life into a regional document of the Council of Europe written more than 20 years ago, which is already thoroughly outdated and is not in demand among developing countries. Does the world need such a treaty? Apparently not.
Besides, all of the Ad Hoc Committee's work is accompanied by an aggressive media background of the US-controlled media, which claims that “with the help of the convention, Russia and China are going to control the whole world,” or “the convention will create a dangerous precedent that plays into the hands of authoritarian regimes.” Then a rhetorical question arises: who controls the Internet and the global information space now?
Another important reason for the strong opposition to the new UN treaty is the fact that the UN process does not fit into the US-imposed paradigm of a “rules-based order.” Equal international cooperation is not implied. The main role in the future search for ICT criminals is assigned to the International Criminal Court (ICC), which is seen by the West as another alternative to the UN Convention on Countering the Use of ICTs for Criminal Purposes.
Giving the ICC broad powers to conduct ICT investigations and create an attribution mechanism, Washington plans to use it to deliver verdicts and assign responsibility. That is why the West is trying to bracket out extensive criminalization in the future UN treaty, assuming that all these "complex" acts, including ICT terrorism, will not be considered in the UN, but in the US-controlled ICC. The responsibility of finding traces and providing evidence, on the other hand, will fall to American IT giants. Bypassing the mechanisms of mutual legal cooperation between states, citizens of any state suspected of committing crimes in the information space will be “hunted”. Thus, the mechanisms of international cooperation of the UN in decision-making will be substituted.
Based on this, we can conclude that there is no alternative to a future comprehensive convention under the auspices of the UN. Russia, for its part, will continue to provide technical assistance to countries in need based on the principle of protecting State sovereignty and to debunk any manifestations of neo-colonial practices in the global information space.
The Ad Hoc Committee is to submit the final text of the convention to the UN General Assembly at its 78th session (in 2024).

• While condemning terrorism, we emphatically disagree with the assertions that it is possible to respond to terrorism by violating the norms of international humanitarian law, including the indiscriminate use of force against facilities where the civilian population is present. This includes hostage-taking and other actions that, as I have said, go against international humanitarian law.

🌐 The Soviet Union was among the main initiators of establishing the State of Israel at a time when the United Kingdom did not care about this issue very much, after leaving the region in chaos. The Palestinian state has not been established to date for a variety of reasons. This prospect became more and more elusive at every historical stage. The territory allotted to the Palestinians during the establishment of Israel was consistently reduced several times based on actions on the ground.

• Abstracting from the immediate, momentary processes associated with manifestations of extremist sentiments, one cannot but recognise in historical terms that the failure to resolve the issue of establishing a Palestinian state is, in my opinion, the most serious factor used to fuel extremism and terrorism in that region.

☝️ We consistently express our disapproval of terrorism and the unacceptability of responding to terrorism in a way that inflicts harm on innocent civilians. We call for an immediate end to the hostilities after this heated period of the conflict is over. This is how our resolution, which we submitted to the UN Security Council twice, differs from the American resolution which does not address ending hostilities, but solely condemns Hamas.

The latest flare up of the chronic crisis in the Middle East is caused by Washington’s inability to resolve conflicts, the Russian President explained during his meeting with the Iraqi Prime Minister in Moscow.

‘I believe many would agree with me that it is a glaring example of the failures of the US Middle East policies. They tried to monopolize the peace settlement, but unfortunately paid no attention to searching for compromises that would be acceptable for both parties. Instead, Washington put pressure on both sides in an attempt to impose its own solutions on them.’

Last week, Palestinian militant group Hamas (based in Gaza) launched a surprise attack on southern Israel. The Israeli army responded with bombardments in Gaza – the small coastal land with some 2 million residents living under an Israeli blockade since 2007.

After joining IORA with the status of dialogue partner, Russia has been successfully integrating to the practical work of this platform in various spheres of the Indian Ocean Rim agenda, such as maritime, commercial and investment, ecological cooperation, as well as fishing and tourism. In July 2023, relevant Russian authority – Ministry for the Economic Development has organized a special online seminar on the “Blue Economy” to explore the best practices and technologies for effective management of the ocean resources.
Basing on the experience of the multilateral regional mechanisms like SCO, EAEU, ASEAN+, Asia cooperation dialogue, CICA etc. Russia promotes formation of the transcontinental international relations through connection of the unions and organizations aiming at positive cooperation in the name of mutual development.
We appreciate the balanced position of Sri Lanka in the international relations. We are glad to see that this year Sri Lanka is hosting the high-ranking meetings in relation with the chairmanship of that country in the IORA and hope that this event will be fruitful for the whole region.

Russian nuclear energy major Rosatom has officially handed over uranium to the Bangladeshi authorities to fuel the country’s first nuclear power plant, which is being constructed by Russia in Ruppur, Pabna district in the western part of the country.

The first of two units of the 2,400 MW Rooppur Nuclear Power Plant is expected to be operational next year, providing much-needed energy to the emerging regional economic power. With the handing over of fresh nuclear fuel to the Bangladeshi authorities today, the country will become the 33rd nuclear fuel user in the world.

Address on Day of Reunification of the Donetsk People’s Republic, Lugansk People’s Republic and the Zaporozhye and Kherson Regions with Russia

I congratulate you on the occasion of the Day of Reunification of the Donetsk and Lugansk people’s republics, and the Zaporozhye and Kherson regions with Russia.

A year ago, on September 30, a defining and truly historic event took place when agreements were signed to incorporate four new constituent entities into the Russian Federation. Millions of residents of Donbass and the Kherson and Zaporozhye regions made their choice to be with their Fatherland.

This conscious, long-awaited, hard-won and genuinely popular decision was made collectively through referendums in full compliance with international norms. People showed courage and integrity in the face of attempts to intimidate and deprive them of their right to determine their own future, their destiny, and to take away something every person values, namely, culture, traditions, and mother tongue, in a word, everything that was loathed by nationalists and their Western patrons who orchestrated a coup in Kiev in 2014 and then unleashed a full-scale civil war and terror against dissenters and organised blockades, constant shelling, and punitive actions in Donbass.

But nothing and no one can break the will of millions of people, or their belief in truth and historical justice. The free and unequivocal choice of our brothers and sisters was wholeheartedly supported by the Russian people. We understood and deeply felt the most important thing: by defending our compatriots in Donbass and Novorossiya, we are defending Russia itself. Together, we are fighting for the Motherland, for our sovereignty, spiritual values, unity, and victory. I thank all the citizens of the country for this solidarity and patriotism.

Today, we are also building our common future together, rebuilding and building schools and hospitals, housing and roads, museums and memorial sites. All our regions are providing truly fraternal assistance to the cities and towns of Donbass and Novorossiya. Volunteers, civil and religious organisations, parliamentary parties, entrepreneurs, and labour collectives all contribute to this work and common cause. Our entire large and united country is working together.

The recent elections in the Donetsk and Lugansk people’s republics and the Zaporozhye and Kherson regions were an important step in strengthening our common state and the political and legal space. Just like a year ago during the historic referendums, people once again expressed and reaffirmed their desire to be with Russia, and supported their fellow citizens who earned the people’s trust through hard work and real achievements.

Much work lies ahead of us to address complex challenges and implement a large-scale programme for the revival and socioeconomic development of our historical regions. We will by all means achieve our goals.

I would like to address the residents of the Donetsk People’s Republic, Lugansk People’s Republic, and the Zaporozhye and Kherson regions specifically. Thank you for preserving and passing on your love for the Fatherland to your children despite all the trials. Thanks to you, your fortitude and determination, Russia has become even stronger. We are one people, and together we can overcome anything and meet any challenge.

The Embassy is pleased to inform the respected audience about the following.
This night (August 11, 2023) Russia’s “Luna-25” space and lunar station has been launched successfully from Roscosmos’ Vostochny Cosmodrome. The automatic module was put on flight path to the Moon from the Earth orbit and now the spaceship is on its way to the Moon. The launch of the automatic station into circumlunar circular orbit is scheduled for August 16, with a touchdown on the lunar surface on August 21.
This is the first Russian Lunar Mission since late 1970s. The next three “Luna” stations will be launched in 2027, 2028 and 2030. Russia is on its way forward, to the historic turn of the Mankind from its cradle in the Earth to its future in the outer space. Despite of the illegal sanctions and other restrictions that are being imposed by the West to save its dominance and to impede other nations’ will to live just and free, it is not possible to stop the temptation of all progressive peoples for further development.

About the EU’s neo-colonial policy in Africa

The European Union regards itself as a privileged partner of Africa that takes special “care” of the continent and may therefore force its policies onto African countries in a paternalist manner. At the same time, the EU is not willing to assume responsibility for the crimes committed by the European colonial regimes and their consequences for Africa’s development, or to provide real assistance, without a hidden agenda, to help African countries integrate into the global economy as an equal partner.
To the contrary, the EU has been working systematically to increase African countries’ dependence in a broad range of areas, including financial and economic policy, food and energy security, healthcare, and the stability of public administration.
It is to notice the growing exploitation of African countries’ resources, including their population. The fragmentation of the global economy and increased competition for resources have confronted the EU with the need to increase investment in Africa, but not in the interests of Africans. The goal is to ensure the sustainable development of the European Union rather than Africa. The best the EU can offer Africa is programmes to create conditions for the training and maintenance of the workforce that will service the mining and transportation infrastructure the EU needs.
The EU is doing this to entrench Africa’s subordinate position in the bloc confrontation between “democracies” and “autocracies,” which the West is forcing on the international community. In fact, the West is trying to turn Africa into a raw materials colony giving the West guaranteed access to its raw materials in return for limited access to some “boons” of Western civilisation.
The main role in this undertaking has been assigned to the EU initiative known as the Global Gateway (GG).
We regard GG as nothing more than a way of ensuring the interests of the collective West to the detriment of the global majority. Essentially, the countries that set their eyes on EU investment in their infrastructure and economic development as a whole are invited to play on the “democratic side of history” by accepting a certain set of principles, including Western values, human rights, environmental and other standards, and demonstrating readiness to cooperate in the fight against hybrid threats and the use of “economic coercion for geopolitical goals.” Ultimately, the West would like to maximally expand its economic sphere of influence that operates according to the Western rules, as well as create additional leverage to enact socioeconomic (and through them internal political) processes in the beneficiary countries.
When it comes to Africa, GG is just a new edition of the EU’s development assistance policy. The main difference is the much more rigidly uncompromising methods of enforcing Western recommendations, including a confrontation policy towards certain third countries (Russia, China).
In other words, the EU continues to use its financial assistance to African countries for political purposes. The real goal of giving assistance to Africa is to create favourable conditions for the economic interests of the West and transnational corporations. Meanwhile, the West has no regard for the African countries’ real needs. Despite the multibillion assistance programmes the EU has implemented over the past decades, Africa has not made great strides towards industrialisation. Moreover, enforcement of the EU’s methods has led to the demise of generally successful economic sectors in many African countries.
The volume of the EU’s assistance is not sufficient for African countries to gain real economic sovereignty on the conditions offered in Brussels. The 150 billion euros it has promised to mobilise for African needs by 2027 within the framework of GG breaks down to 20 euros per capita annually over the next five years. This pales in comparison to the EU’s assistance to Ukraine: nearly 80 billion euros since the end of February 2022 or about 2,500 euros per Ukrainian. Although seemingly attractive, the economic development model the EU is forcing on Africa can only be viable with much larger investment in the African economy and the termination of the practice of debt bo***ge, including the export of transnational companies’ profits earned in Africa.
The EU’s Generalised Scheme of Preferences (GSP) is one of the key trade and political tools of EU neo-colonialism, which includes a preferential trade regime based on an “everything but arms” arrangement, which formally provides products from the least developed countries (LDCs) with duty-free and quota-free access to the EU market. The EU monitors the GSP on an ongoing basis. Based on the results of the monitoring, the preferences can be suspended or canceled at any time, in particular, for political reasons.
Even under the preferential trade regime granted by the EU to African countries and amid statements by EU officials about the contribution of trade agreements between the EU and African countries to ensuring their economic growth in 2013-2022, the total EU-Africa trade balance in favour of the EU exceeded 83 billion euros. And this is just the tip of the iceberg revealing the scale of the EU’s systematic exploitation of the African continent, which relies on raw material exports from Africa and imposing EU-made products with high added value on Africans.
The EU policy aggravates the systemic problems facing Africa, a compelling example of which is the worsening food security situation in Africa which is unfolding amid the EU sanctions imposed on the Russian agro-industrial complex, which makes it difficult to export Russian fertiliser and grains to African countries in need. The EU is not going to reimburse African countries for economic damage from possible shortages of Russian fertiliser and grain supplies due to EU sanctions, or from eventual rupture of economic cooperation with Russia in other areas under Western pressure.
The West is using sanctions mechanisms to put political pressure on undesirable African countries, thus worsening the socioeconomic situation in conflict zones and exacerbating adverse humanitarian consequences. Attempts are being made to discredit bilateral cooperation between Russia and sanctioned countries through planting fake claims in the media about our alleged violations of the corresponding UN Security Council resolutions.
Taking advantage of the underdeveloped fishing industry even in relatively prosperous African states, the EU imposes predatory terms on them in “sustainable fishing” agreements, which allow EU fishing vessels to deplete their marine resources causing damage to the environment and the interests of local fishermen, though provisions on development assistance are formally included in the documents.
Clearly, the EU seeks to create in Africa parallel channels of interaction with NGOs that are on their payroll, which are being widely and purposefully used to lobby the EU’s interests and to implement project activities that meet its objectives. Financial assistance is often provided in circumvention of official bodies directly to NGOs, which is an act of blatant disrespect for the sovereignty of African states and undermines their internal political stability.
By allocating funds for holding electoral events, Brussels is trying to de facto exert direct control over domestic political processes in African countries, thus contributing to the transformation of the public administration system to fit its needs and the entrenching of the Western-oriented elites in power.
