O Tribunal de Justiça da União Europeia (TJUE) decidiu no processo C 242/22 PPU de 1.08.2022 que a violação das normas relativas ao direito à interpretação e tradução em processo penal não tem de ser arguida num determinado prazo, sob pena de sanação, quando esse prazo começa a correr ainda antes de a pessoa em causa ter sido informada, numa língua que ela fale ou compreenda, da existência e do alcance desse direito e da existência, conteúdo e efeitos do documento essencial em questão.
European Union Law
Court of Justice of the European Union (CJEU) has ruled in Case C 242/22 PPU, 1st August 2022 that the infringement on the right to interpretation and translation in criminal proceedings is not to be invoked within a specified time-barred period, where that period begins to run before the person concerned has been informed, in a language which he/she speaks or understands of the existence and scope of such right and of the existence and content of the essential document in question and the effects thereof.
