I have had the pleasure of attending the Family Law Conference in Ōtautahi.
The speakers were absolutely brilliant, discussing all areas from psychology, access to justice, relationship property, our legal and social systems along with the importance of tikanga Māori.
We were challenged to reflect on our own practices and how we can all contribute to better outcomes. As family lawyers, we are privileged to advocate for our clients through some of the hardest moments in their life and we are also dealing with their most treasured taonga, their tamariki.
We not only analyse the law and how it applies to our clients but we also navigate all of the emotional aspects that come with it. This can be all-consuming and it most certainly is not an easy job to leave at the office. We do our best to help our clients and their tamariki carry the load so that no one is alone when they go through the Family Court system.
I know for certain that there are many lessons which I will implement in my own practice so that I can continue achieving the best outcomes possible for my clients and their tamariki.
The theme of the conference was Te Hononga - Connection. Connection not only with our clients but also with our fellow practitioners. There is a brilliant family bar in not only Waikato but all of Aotearoa. The level of collegiality between family lawyers never ceases to amaze me and I feel honoured to work alongside so many passionate, intelligent and genuine people.
Thank you to NZLS and the Family Law Section for such an inspiring event with so much knowledge shared and just the right amount of dancing.
👩👧👦👨👧👦 Parenting 👨👦👦👩👦👦
Deciding who cares for our children and when the other parent has contact can be super tricky after separation.
All decisions that are made in respect of parenting matters need to have the child’s welfare and best interest at the forefront.
This means:
• Keeping them safe, emotionally and physically
• Both parents or guardians being involved
• Consulting and co-operating with the other parent or guardian
• Providing continuity for our children’s care, development and upbringing
• Protecting their relationship with the other parent and their wider family, whānau, hāpu and iwi
• Preserving and strengthening their identity
• Giving our children the chance to be involved in making decisions which affect them

One of the biggest things I’ve reflected on this month is litigation risk. Litigation risk refers to the fact that the outcome of a court hearing always depends on the evidence and how it comes across on the day.
We can never guarantee you the result of court proceedings but I can guarantee you that you will walk into court knowing all of the risks, likely outcome and that we have explored all options before heading into hearing.

Things can get oh so messy after a loved one has passed away.
The Family Protection Act 1955 provides a framework for people to claim against an estate if adequate provision has not been made for the proper maintenance and support of specific family members.
This is a super interesting area of the law and if you believe that proper provision has not been made for you after the passing of a loved one, it may be worth investigating to see whether the Act applies to your circumstances.
⭐️⭐️ PPPR Orders ⭐️⭐️
If a family member has lost capacity to make decisions for themselves then you can apply to the Family Court to be appointed as a welfare guardian and property manager. These are known as PPPR Orders.
In order to be able to apply, you need to be a family member, the person cannot have legal capacity and they cannot already have appointed an attorney to make decisions on their behalf.

What a hectic time March has been.
Urgent court hearings, a full to the brim case load and a wedding. Add that on top of the day to day family juggle of having three kids, it’s fair to say that this last month has been huge.
I am so grateful for all of the clients I have met so far and that I have been entrusted to help guide them through the legal system.

🏠 Relationship Property 🏠
What is it and why do you need to know?
Relationship property are all the things which you and your partner will divide 50:50 if your relationship ends. It includes both assets and debts.
Clients are often caught out thinking that if only their name is on the title or they brought it to the relationship that it will stay theirs.
Sorry to say that’s not the case. Once you hit the three year mark, anything that falls into relationship property is fair game and would be split 50:50.
A house that’s in your sole name, your car that you owned before the relationship, a business that’s yours but your partner has been helping you with, the portion of your KiwiSaver or super you’ve contributed since the relationship began, inheritance that you’ve paid towards your joint house, it’s all relationship property.
If you’re not quite ready for your partner to be entitled to 50:50 or you’re not ready to be liable for their debts, there are options.
Make sure that you and your partner set the rules about what happens with your property!

The Property (Relationships) Act 1976 sets the rules for how property is divided at the end of a relationship and it applies as soon as you hit the three year mark… and sometimes sooner.
