The West Philippine Sea has yet again become a source of tension between our nation and the People’s Republic of China. Despite the promulgation of the decision rendered by the Permanent Court of Arbitration, questions and doubts still linger regarding our claim over the disputed Sea. There is a pressing need to refresh the public’s memory on the basis of, and our standing in, this dispute.

Florin T. Hilbay’s “Managing Philippines v. China: The Role of the Agent” is an autobiographical account that delves into the thought processes of those acting on behalf of our nation during the proceedings of the landmark P.C.A. Case No. 2013-19, otherwise known as “In the Matter of the South China Sea Arbitration.” Specifically, it discussed the role played by the Author as part of the team under the Solicitor General, and the process of learning international procedural rules and concepts. While giving a unique perspective, this Article highlights the Philippine government’s objectives and the means used to obtain its goals. It likewise discusses the role of the Agent as a “team manager,” the structure of the arbitration team, and the framing used for the arguments, which ultimately led to the favorable ruling in the case.

In conclusion, the Author emphasized how important it was to avoid any appearance of favor towards a compromise, as that would be less than faithful to the Constitution, our nation’s interest, and the goal of maximizing entitlements. By standing their ground, the team was able to obtain a favorable decision which stood to impact not just the livelihoods and security of the current generation, but those of the future as well. The First Issue of the Ateneo Law Journal’s 67th Volume is now available online.

The law expands and evolves as it adapts to the changes of modern times. As part of the Journal's tradition, the First Issue of every volume features the recent updates and developments in the Philippine legal landscape.

Opening the issue is the illuminating amicus curiae brief by Professor Elizabeth H. Aguiling-Pangalangan which guided the Supreme Court for its latest doctrinal pronouncement in Aquino v. Aquino. The Memoranda analyzed the implications of Article 992 on the successional rights of illegitimate children in view of the constitutional principles of due process and equal protection.

On the subject matter of intellectual property, Atty. Felicisimo F. Agas III and Atty. Zarah Mae L. Rovero-Calderon, in their Article entitled, "Pruning the Divergence: Examining Zuneca and Kolin and Their Effects on the Multiverse of Rules Governing Trademarks," examines the jurisprudential tests on trademark recognition and protection in the hope of streamlining and providing a coherent set of guidelines for trademark law.

The Issue features a wide array of topics to cover not only topics of popular discussion, but also those of more niche fields in line with the Journal's mission of contributing richly to legal discourse and scholarship.
