Republic Act No. 10054 – Motorcycle Helmet Act.

Republic Act No. 10054, also known as the “Motorcycle Helmet Act” was signed into law on 23 March 2010. An act mandating all motorcycle drivers to wear standard protective motorcycle helmets while driving is now in full effect nationwide.

The memorandum circular on the Republic Act (RA) 10054 or the helmet law issued on December 26, 2011, was already received by all regional offices of the Land Transportation Office (LTO), Department of Transportation and Communications (DOTC) and the Department of Trade and Industry (DTI).
LTO Regional Director Camilo Guarin said that after the prescribed six months (January-July 2012) of massive campaign and information campaign, starting next month, his office will start implementing the provisions of RA 10054.

Some salient provisions of RA 10054 are:

Section 3 – Mandatory Use of Motorcycle Helmets. All motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway. Standard protective motorcycle helmets are appropriate types of helmets for motorcycle riders that comply with the specifications issued by the DTI.

Section 5 – Provision of Motorcycle Helmets. A new motorcycle helmet that bears the Philippine Standard (PS) mark or Import Commodity Clearance (ICC) of the Bureau of Product Standards (BPS) and complies with the standards set by the BPS shall be made available by every seller and/or dealer every time a new motorcycle unit is purchased and which the purchaser may buy at his option. Failure to comply with the requirements provided under this section shall constitute a violation of this act.

Section 7 – Penalties. (a) Any person caught not wearing the standard protective motorcycle helmet in violation of this act shall be punished with a fine of
P1,500 for the first offense;
P3,000 for the second offense;
P5,000 for the third offense; and
P10,000 plus confiscation of the driver’s license for the fourth and succeeding offenses.

(b) Any seller and/or dealer who violates section 5 of this act shall be punished with a fine of not less than P10,000 but not more than P20,000.

(c) Any person who uses, sells and distributes substandard motorcycle helmets or those that do not bear the PS mark or the ICC certificate shall be punished with a fine of not less than P3,000 for the first offense; and P5,000 for the second offense, without prejudice to other penalties imposed in Republic Act No. 7394 or the “Consumer Act of the Philippines.”

(d) Tampering, alteration, forgery and imitation of the PS mark and the ICC certificates in the helmets shall be punished with a fine of not less than P 10,000 but not more than P20,000 without prejudice to other penalties imposed in RA 7394 or the “Consumer Act of the Philippines.”

Kaarawan ni G*t Andres Bonifacio at Ika 2 taong anibersaryo ng Aguila Riders Club.

Ang Andres Bonifacio Day ay isang pambansang pista opisyal sa Pilipinas na ipinagdiriwang tuwing ika-30 ng Nobyembre upang alalahanin ang anibersaryo ng kapanganakan ng pinakadakilang bayani ng bansa, si Andres Bonifacio. Ipinanganak siya noong Nobyembre 30, 1863, at tinaguriang Ama ng Rebolusyong Pilipino laban sa kolonisasyon ng mga Espanyol.

Ito ay taonang ipinagdiriwang ng mga kasapi ng Alliance of General Unions, Institution Labor Association (AGUILA) sa pamamagitan ng Solidarity Night. Isang gabing punong puno ng kasiyahan, kantahan, kumustahan at pagkakaisa. Bago ang Solidairty Night ay lumalabas sa kalsada ang lahat ng membro upang irehistro ang mga hinaing sa Gobyerno, ipagsigawan ang mga kagustuhan pagbabago tungo sa kagalingan at kabutihan ng Uring Manggagawa.

Dahil sa taonang pagdiriwang ng kaarawan na ito ay nabuo ang AGUILA Riders Club mula sa hanay ng mga leader manggagawa at riders ng AGUILA na naghahanap ng hustisya laban sa diskriminasyon at papalaking bilang ng mga delivery apps riders, hango sa mga manggagawang nawawalan ng mga trabaho sa panahon ng pandemya, mga problema sa kalsada, atbp.

Ngayong taon ay muling makikiisa ang Aguila Riders Club sa taonang pagdiriwang ng kaarawan ni G*t Andres upang irehistro ang hinaing at mga nais na pagbabago tungo sa kabutihan, kagalingan at karapatan ng lahat ng Riders. Isa na nga rito ang pagbasura ng Doble Plaka Law at paglalagay sa makatarungan ng mga penalty sa kalsada na may makatao panuntunan. Pangalawa, pagpapabilis ng proseso sa pagbibigay ng libreng Theoretical Driving Course TDC at pagkakaroon ng LTO Drivers Education Center office sa lahat ng probinsya sa buong kapuluan. Ikatlo, ay pagkakaroon ng isang institusyong mag-aaral sa kasalukuyang sitwasyon ng mga riders, nagmamaneho at mananakay sa buong kapuluan upang mabigyan ng kaukulang lunas at sulusyon ang lomolobong mga naaksidente sa kalsada.

WAGE DISTORTION

Mayroong wage distortion kapag nagkaroon ng government-mandated increase (wage order) tapos ay nagkalapit na ang mga sahod ng mga manggagawa na may magkakaibang role sa kumpanya o years of service.

Ibig sabihin, kahit above minimum wage ka, pwede ka pa din mabigyan ng pagtaas sahod ng wage order kapag may WAGE DISTORTION

Marami ang paraan ng pag compute nito. Kapag may unyon ay pwede idaan sa Grievance Procedure. Kapag walang unyon ay pwede naman ifile ang reklamo sa NLRC o DOLE.

Budget Watch: P125 Million in 11 days?

Sa pagpapatuloy ng usaping pondo, mainit na issue ngayon ang naungkat na 125 Milyong Pisong pondo ng Office of the Vice President (OVP) noong 2022. Noong umpisa ay naging mainit ang tanungan kung saan nanggaling ang pera kahit na wala namang budget ang OVP para sa Confidential Funds sa ilalim ni Leni Robredo. Nagkaroon lamang ito ng budget noong pumalit na si VP Sarah Duterte.

Ang paliwanag ng kampo ni VP Sarah, galing daw sa contingency funds ng Office of the President ang budget. Pero may mas malaking katanungan ang dapat sana nila sagutin sa taong bayan. Nitong nakalipas na mga araw habang nagpapatuloy ang usapin tungkol sa budget ay muling natalakay ang 125 Milyong Piso na confidential funds. Dito ay natanong ni Rep. Brosas si Rep. Quimbo kung pwede bang kumpirmahin ng COA ang pagastos ng pondo ng OVP sa loob ng 19 na araw. Sinagot naman ito ni Brosas na ayon daw sa mga reports nila ay ginastos ito ng OVP sa loob ng 11 days.

Labing isang araw, inubos ng OVP ang 125 Million Pesos na Confidential Funds. Sa ngayon ay patuloy parin daw ang audit ng COA kung saan napunta ang budget. Maglalabas daw ng report ang ahensya sa Nobyembre 15. Kung ating kukwentahin, gumastos ng mahigit 11 Million ang OVP sa loob ng labing isang araw noong 2022.

Hindi lang ito usapin ng kung paano ginastos at gaano ka bilis. Ito ay usapin ng pang aabuso sa pondo na laganap na sa buong burukrasya. Sobrang garapal lang itong kay Sarah Duterte. Pangalawa, usapin ng batayan. Bakit may confidential fund ang isang sibilyan na ahensya? Malinaw na ina alibi o cover lang itong confidentiality upang nakawin lang naman ang naturang pondo. Idagdag pa ang isyu ng paggiging illegal at unconstitutional nitong partikular na kaso na direktang may kinalaman ang Bise Presidente. At dahil illegal nararapat lang na masampaan ng nararapat na kaso.

Ang buong burukrasya ay magkasing-kahulugan sa katagang katiwalian kung saan likas na umiiral ang sistemang "SOP," o "kalakaran" na simpleng salita ay porsyento, lagay, komisyon, tongpats, kickback sa lahat ng proyekto, supply, events, lahat na, involving people's money. Medyo bago itong confidential o intelligence fund. Dati confined lang sa ilang ahensya lalo na sa militar, kapulisan, presidente, gobernador, mayor. Ngayon kahit OVP, Dep Ed, etc. at parang ang nangungunang advocate ay mismong Bise Presidente. Panibagong porma ng tapat-tanghali na kaswapangan as if di pa sapat ang dati nang mga pamamaraan na ayon sa datos ay kumakain na nang at least 40% ng buwis ng mamamayan.

Ano kaya kung ang Bise Presidente ngayon ay maging Presidente na. Malamang, di lang Pasismo ang iiral, ang nakawan at katiwalian ay mas lalong lalaganap at madadagdagan under the cover of Confidentiality.

Kung ganito nalang palagi ang takbo at sistema ng pag gastos ng pamahalaan sa bansa, hindi malayong lalo tayong mabaon sa utang. Ang nakakatakot pa ay hindi natin alam kung tunay bang napupunta sa serbisyo ang ginagastos na pera. Isang panawagan sa mamamayan, nawa'y maging aktibo tayo sa pagbantay, pag kwestyon at pag puna sa bawat galaw at paglaan ng gobyerno sa budget na nanggagaling sa buwis ng taong bayan. Magkaisa upang labanan ang katiwali-an!

PAG PILI NG REST DAY BASED ON RELIGIOUS GROUNDS

Management prerogative ang pagpili ng rest day ng manggagawa. Pero kung ang pagpili ng rest day ng manggagawa ay dahil sa kanyang relihiyon, dapat ito irespeto ng employer.

Yan ang nakasaad sa Article 91 ng Labor Code:

Article 91. Right to weekly rest day.

It shall be the duty of every employer, whether operating for profit or not, to provide each of his employees a rest period of not less than twenty-four (24) consecutive hours after every six (6) consecutive normal work days.

The employer shall determine and schedule the weekly rest day of his employees subject to collective bargaining agreement and to such rules and regulations as the Secretary of Labor and Employment may provide. However, the employer shall respect the preference of employees as to their weekly rest day when such preference is based on religious grounds.

MAINAM GAWIN KAPAG NAHULI KA...

: Mahinahon mong itanong kung anong violation mo kung wala kang idea kung bakit pinara ka ng enforcer. 'Wag mong ibigay agad ang iyong lisensya kapag hindi sinabi o pinaliwanag ng enforcer ang violation mo.

Kung alam mo naman na may paglabag ka ay mas mabuting ibigay na agad ang iyong lisensya.

: Kapag sinabi o pinaliwanag ng enforcer ang violation mo, agad na ibigay mo ang iyong lisensya. Pagkatapos mong ibigay, magsimula ka nang makiusap baka sakaling pagbigyan ka.

Huwag magagalit kapag hindi pinagbigyan sa pakiusap. Ugaliin nating maging patas palagi at marunong tumanggap ng pagkakamali.

: Pinagbigyan ka man o hindi, tinikitan ka man o hindi, palaging magpasalamat sa enforcer. 🙂
