In the recent years, there has been some progress in Russia to reinforce the efforts in combatting the infringements of intellectual property rights. As a requirement for entering World Trade Organization back in 2012, they matched their legislation with international standards by passing laws which aimed to combat production of fake goods, anti-piracy laws especially for the web etc. This all seems to be suspended at the moment as since March, a decree was passed which modified the “Methodology for Determining the Amount of Compensation Paid to a Patent Owner When Deciding to Use an Invention, Utility Model or Industrial Design without His Consent”.
Basically now, unauthorized use will not be compensated to companies coming from countries “unfriendly” to Russia. As a response to the western sanctions, the Russian government has published a list of countries and now it seems that the patent theft in Russia will be one more thing these countries should worry. Many companies have already ceased doing business with Russian companies while sanctions have greatly affected the Russian economy. The move however is unprecedented in terms of using IP rights as part of the war strategy, at least recently. (Some bring up the Trading with the Enemy Act which implemented property seizure during WWI aiming to prevent immigrants to financially or materially support the enemies of America.) It also violates multiple international treaties which the countries of WTO are obliged to guarantee.
