Competition Law and Policy in Ukraine – Wartime Overview

The Russian military aggression against Ukraine in 2022 disrupted various sectors, including competition enforcement. As the Antimonopoly Committee of Ukraine (AMCU) faced unprecedented obstacles, its strategies evolved. Initially relocating due to safety concerns, AMCU suspended several functions. However, resilience emerged as it resumed operations step by step. With a spotlight on key sectors like energy, finance, and property auctions, AMCU adapted to the evolving landscape. The war's economic toll and the AMCU's post-war role hold significance. A focus on competition, transparency, and international cooperation will shape Ukraine's revival."

On 15 April 2022 NOBLES partner Oleksandr Aleksyeyenko was a speaker at the 26th Global Forum “Practicing law in the face of military confrontation – Challenges for lawyers under severe circumstances”.

The Forum was organized by the Swiss Chinese Law Association – a legal and industry community comprised of over 200 legal experts, CEOs and Government officials. The forum invited speakers from Ukraine, Argentina, Spain, United Kingdom, Germany, China, Nigeria, Singapore, Poland and Bulgaria to share their views on current aspects of legal practice in the course of wars and how military conflicts influence various businesses around the world.

Oleksandr was speaking about the sanctions regime (introduced and implemented both internationally and locally in Ukraine) and prospects of compensating damages caused by the Russian invasion into Ukraine. Oleksandr emphasized that sanctions now being imposed against Russia aim at not just freezing assets for reconstructing Ukraine after the war, but primarily at stopping the war itself. While the Ukrainian government takes measures to properly document and investigate multiple war crimes, it also develops methodology of assessing and calculating various types of damages. Besides this, the strategy of legal actions and claims against Russia is now being developed.

It was interesting to realize the historical experiences of practicing law during the British-Argentina war over Falkland island. The speakers also shared their thoughts on human rights violations and international crimes investigations that are going to make many international specialists busy in the coming years.

The panelists also deeply analyzed the current state of affairs of trade disputes resolution procedures and what could be made to relaunch and improve the available procedures in view of the current increase of sanctions.
